Paternitātes noteikšanas ar trīspusēju paternitātes atzīšanas iesniegumu un paternitātes apstrīdēšanas problemātika.

Abstract

Autores izvēlētā bakalaura darba tēma ir “Paternitātes noteikšanas ar trīspusēju paternitātes atzīšanas iesniegumu un paternitātes apstrīdēšanas problemātika”. Mūsdienās, Latvijas normatīvie akti paredz vairākus variantus, kā noskaidrot bērna izcelšanos, kas būtiski ir atvieglojis iespēju arī bioloģiskajam tēvam atzīt savu paternitāti bērnam. Normatīvie akti šobrīd skaidri paredz, ka katram bērnam ir tiesības apzināties savu izcelšanos, kā arī tiesības uz savu identitāti. Bakalaura darba mērķis ir izpētīt paternitātes noteikšanas ar trīspusēju paternitātes atzīšanas iesniegumu izmantošanas iespējas Latvijā, tā regulējumu esošajos normatīvajos aktos un esošās problēmas, kuras ir nepieciešamas atrisināt, kā arī salīdzināt paternitātes regulējumu atšķirību starp citām valstīm. Tāpat darba mērķis ir analizēt paternitātes apstrīdēšanas problemātiku. Darba gaitā autore ir analizējusi dažādu autoru rakstus, kā arī Latvijas un ārzemju tiesu praksi. Pētījumā autore koncentrējusies uz dažādām termiņu nepilnībām saistībā ar paternitāti, kā arī pētījusi to samērīgumu. Tāpat autore padziļināti izpētījusi esošās nepilnības saistībā ar trīspusējo paternitātes atzīšanas iesniegumu.

The topic of the bachelor's thesis chosen by the author is "Problems of determining paternity with a tripartite application for recognition of paternity and contesting paternity". Nowadays, Latvian regulatory enactments provides for several options for ascertaining the origin of a child, which has significantly facilitated the possibility for the biological father to recognize his paternity for the child. Regulatory enactments now clearly states that every child has the right to be aware of his or her origin, as well as the right to his or her own identity. The aim of the bachelor's thesis is to study the possibilities of using paternity determination with tripartite paternity recognition applications in Latvia, its regulation in the existing regulatory enactments and the existing problems that need to be solved, as well as to compare the differences in paternity regulations between other countires. The aim of the work is also to analyze the issue of contesting paternity. In the study, the author has focused on various gaps in terms related to paternity, as well as studied their proportionality. The author has also thoroughly researched the existing shortcomings in connection with the tripartite application for recognition of paternity.
