Labas ticības principa piemērošana prasībās par kopīpašuma izbeigšanu.

Abstract

Bakalaura darba temats ir “Labas ticības principa piemērošana prasībās par kopīpašuma izbeigšanu”. Darba mērķis ir izpētīt kopīpašuma institūtu, labas ticības principu, šī principa piemērošanas nozīmi prasībās par kopīpašuma izbeigšanu un tā problemātiku. Apskatīt un noteikt iespējamos kopīpašuma regulējuma grozījumus. Lai sasniegtu mērķi darba autore izvirzīja uzdevumus izpētīt un analizēt Latvijas Republikas Civillikuma regulējumu un juridisko literatūru par kopīpašumu, labas ticības principa piemērošanas nozīmi Latvijas tiesu praksē par kopīpašuma izbeigšanu, kā arī iespējamus kopīpašuma regulējuma grozījumus. Pētījuma rezultātā autore secina, ka ir nepieciešami skaidri izteikti kopīpašuma regulējuma grozījumi, un labas ticības princips ir ņemams vērā prasībās par kopīpašuma izbeigšanu.

Bachelor’s thesis topic: “Principle of good faith in the context of claims for joint property termination”. The purpose of this bachelor’s thesis is to study joint property, the principle of good faith, its significance in claims for joint property termination. Evaluate and propose possible amendments to the joint property regulation. Tasks were to study and analyse the regulation of the Civil Law of the Republic of Latvia and legal literature on joint property, the significance of the application of the principle of good faith in cases on termination of joint property, as well as the possible amendments to the regulation on joint property. The study concludes – accurate amendments must be established to joint property regulation, and the principle of good faith is applicable in cases of joint property termination.
