Advokātu biroja darbinieku kriminālprocesuālā imunitāte

Abstract

Bakalaura darbā autore analizē, vai advokātu biroja darbiniekiem ir nepieciešama kriminālprocesuālā imunitāte, kā arī kādi ir problēmjautājumi attiecībā uz kriminālprocesuālās imunitātes neattiecināšanu uz advokātu biroja darbiniekiem. Temats ir aktuāls, jo līdz šim Saeimā ir bijis iesniegts priekšlikums grozīt Advokatūras likumu, piešķirot arī advokātu biroja darbiniekiem kriminālprocesuālo imunitāti, taču šis priekšlikums tika noraidīts. Autores mērķis ir noskaidrot, vai advokātu biroja darbiniekiem ir nepieciešama kriminālprocesuālā imunitāte vai nav. Mērķa sasniegšanai autore analizē advokātu biroja darbinieku pienākumus un salīdzina tos ar tiem pienākumiem, uz kuriem advokāts bauda kriminālprocesuālo imunitāti. Kopsavilkumā darba autore identificējot problēmjautājumu, veicot uzdevumus izpētei, nonāca pie secinājuma, ka advokātu biroja darbiniekiem ir nepieciešama kriminālprocesuālā imunitāte, kā arī izvirzīja priekšlikumus šīs kriminālprocesuālās imunitātes piešķiršanai.

In the bachelor's thesis, the author analyzes whether the employees of the law firm need criminal procedural immunity, as well as what are the issues regarding the non-extension of criminal procedural immunity to the employees of the law firm. The topic is topical, because so far a proposal to amend the Law on the Bar has been submitted to the Saeima, granting also the immunity of criminal procedure to the employees of the law office, but this proposal was rejected. The aim of the author is to find out whether the employees of the law firm need immunity from criminal proceedings or not. To achieve the goal, the author analyzes the duties of the employees of the law firm and compares them with those duties to which the lawyer enjoys criminal procedural immunity. In summary, the author of the paper, identifying the problem, performing tasks for research, came to the conclusion that the employees of the law firm need criminal procedural immunity, as well as put forward proposals for the granting of this criminal procedural immunity.
