Nowadays, it is impossible to imagine life without such identifying elements as a name and surname. Therfore, the rights to change the name and surname has been granted. However, this right is not unlimited, so it is important to follow the criteria set by the legislator. But these criteria are not always undersandable, so there are situations where persons have to exercise their rights to change the name and surname by going to court. But also the courts have a different view on how to apply the criteria. The aim of the work is to understand the current situation regarding the exercise of the right to change name and surname in practice and to evaluate the problems that persons may face in the exercise of this right. To achieve the goal, literature, research and analysis of regulatory enactments and legal practice must be performed. As a result of the work, proposals for the improvement of the right to change the name and surname of the existing regulation have been obtained, as well as an assessment of the current regulation has been provided.
