Konkurences tiesības ir tiesisks instruments, kas nodrošina efektīvu brīvā tirgus darbību un tautsaimniecības attīstību, komplementāri aizsargājot sabiedrības kopējo labklājību. Izrietoši, konkurences tiesību pārkāpumu identificēšana, atklāšana un izmeklēšana ir pašmērķis, kura sasniegšanu ir jāveicina konkurences iestādei. Vienlaikus konkurences tiesību pārkāpumu izmeklēšanas procesam ir jābūt efektīvām un tiesiskam, konkurences iestādei īstenojot izmeklēšanas darbības un piemērojot uzņēmuma cilvēktiesības vismazāk ierobežojošus līdzekļus. Autore darbā analizē šobrīd spēkā esošo Eiropas Savienības konkurences tiesību regulējumu, pētot Eiropas Komisijai un nacionālajām konkurences iestādēm piešķirtās pilnvaras īstenot Regulas Nr. 1/2003 18., 20. un 21. pantā reglamentētās izmeklēšanas darbības, kā arī šo izmeklēšanas darbību ietekmi uz uzņēmumiem piemītošajām tiesībām uz taisnīgu tiesu un tiesībām uz privātās dzīves neaizskaramību. Competition law is a legal instrument that ensures efficient functioning of the free market and the development of economy by complementary protecting the common well-being of the public in general. Consequently, the identification, detection and investigation of competition law infringements is a main aim as an end in itself, the attainment of which must be promoted by the competition authority. At the same time, the investigation process of competition law infringements should be effective and conducted strictly in accordance with the rule of law, meaning, the enforcement of the investigative powers by the competition authority shall be done by applying the least restrictive measures on the human rights of the undertaking in question. Author of this thesis analyses the current competition law framework of the European Union by examining the investigative powers provided in the Regulation No. 1/2003 Articles 18., 20. and 21., and that are conferred on the European Commission and national competition authorities, as well as the impact of these investigative powers on the corporate’ rights to a fair trial and the right to respect for private life.
