Efektīvākais lobēšanas regulējuma modelis Latvijas kultūrtelpā

Abstract

Kate Berlaua. Maģistra darbs par efektīvāko lobēšanas regulējuma modeli Latvijas kultūrtelpā. Darba vadītājs: Dr.iur., prof. Sanita Osipova, Rīga, 2021. Latvijai pievienojoties to Eiropas valstu lokam, kas lobēšanas aktivitātes paredzams, ka tuvā nākotnē regulēs normatīvi, aktuāls kļūst jautājums par izvēlētās pieejas lobēšanas regulēšanai efektivitāti. Maģistra darba teorētiskajā daļā autore analizē demokrātiskas tiesiskas valsts konceptu, tajā iederīgos likumdevēja darbības principus un valsts kultūrtelpas lomu normatīvu regulējumu efektivitātes novērtēšanā. Praktiskajā daļā, kur autore analizē lobēšanas regulējuma mērķus un to īstenošanas pieredzi citviet Eiropā, autore secina, ka Latvijas kultūrtelpā potenciāli efektīvākais regulējuma modelis nav vis Eiropā izplatītais obligātais lobētāju reģistrs, bet gan reģistrs lobēšanas procesa atklāšanai, par kura informācijas reģistrēšanu turklāt būtu jāatbild valsts lēmumu pieņēmējiem.

As Latvia joins the European countries by expecting to regulate lobbying activities soon, the issue of the effectiveness of the chosen approach of lobbying regulation in Latvia becomes relevant. In the theoretical part of the master's thesis, the author analyses the concept of state of law and democracy, principles regulating the legislator, and the role of the state’s cultural setting in evaluating the effectiveness of normative regulations. In the practical part, where the author analyses the goals of lobbying regulation and the experience of their implementation elsewhere in Europe, the author concludes that the most effective model of lobbying regulation in the cultural setting of Latvia is not the mandatory register of lobbyists widespread in Europe, but a register for the disclosure of the lobbying process, for the registration of which decision-makers should be responsible.
