Abstract

Maģistra darbā tiek pētīts apsūdzības saturs, apskatot apsūdzības institūtu Latvijā jēdziena plašākā nozīmē, veicot tā normu analizēšanu, galvenos tiesību īstenošanas aspektus un problemātiku. Darba mērķis ir apzināt pašreizējo situāciju praksē, saskatīt problēmas un piedāvāt iespējamos risinājumus pašreizējā regulējuma uzlabošanai problēmjautājumu kontekstā. Autore, izvērtējot iegūto informāciju, maģistra darbā piedāvā iespējamos grozījumus Kriminālprocesa likumā, piedāvā paplašināt Kriminālprocesa likuma 405. panta pirmo daļu ar apsūdzības definējumu, izsakot attiecīgajā redakcijā, tādejādi veidojot vienotu izpratni par apsūdzības definējumu. Tāpat darbā tiek piedāvāti grozījumi un ieteikumi apsūdzības institūta uzlabošanai, raugoties no praksē pastāvošajām problēmām.

The content of the accusation is studied in the master's thesis, looking at the institute of accusation in Latvia in the broadest sense of the term, performing an analysis of its norms, the main aspects and problems of law enforcement. The aim of the Masters thesis is to be aware of the current situation in practice, encounter problems and offer solutions in the context of solving the problems of the current regulation improvement. Evaluating the obtained information, the author in the Master's thesis offers the possibility of amendments to the Criminal Procedure Law, proposes to expand the first part of Article 405. of the Criminal Procedure Law with the definition of accusation, express in the relevant wording, thus creating a common understanding of the definition of accusation. the Master's thesis also offers amendments and recommendations for the improvement of the institute of accusation looking at the problems that exist in practice.
