Abstract

Maģistra darba tēma ir “Pašvaldības teritorijas plānojums kā vides normatīvais akts”. Pašvaldības teritorijas plānojuma kā vides normatīvā akta pētniecība ir aktuāla, jo teritorijas plānošanas un vides aizsardzības regulatīvajās sistēmās konstatējamas tiesiskā regulējuma un prakses nepilnības, kas ietekmē valsts gatavību efektīvi stāties pretī mūsdienu vides problēmu izaicinājumiem. Apzinoties vides problēmu nopietnību, nozīme pieaug arī sabiedrības tiesībām vides stāvokļa aizsardzībā, jo praksē pastāv dažādas tiesiskas problēmas arī sabiedrības līdzdalības nodrošināšanā plānošanas procesā. Darba mērķis: pētīt pašvaldības teritorijas plānojumu kā līdzekli vides aizsardzības jautājumu regulēšanā, identificēt un analizēt pastāvošā regulējuma un prakses problēmas jautājumos, kuros teritorijas plānošana un vides aizsardzība mijiedarbojas visciešāk, pētīt sabiedrības tiesības un to īstenošanu teritorijas plānošanā, piedāvāt priekšlikumus nepilnību novēršanai vai mazināšanai. Darba uzdevumi: izpētīt teritorijas plānojuma un tā regulējuma vēsturisko formēšanos; analizēt teritorijas plānošanas un vides aizsardzības tiesību regulējumu mijiedarbību vides piesārņojuma un dabas aizsardzības jautājumos; noskaidrot ar sabiedrības līdzdalības tiesību īstenošanu saistītās problēmas teritorijas plānošanas procesā un tiesību vērsties tiesā problemātiskos jautājumus; formulēt secinājumus un piedāvāt risinājumus saistībā ar normatīvo aktu īstenošanas problēmaspektiem. Maģistra darba nodaļās un apakšnodaļās ietverts minēto jautājumu apskats un analīze, kā arī formulēti secinājumi un priekšlikumi. The topic of the master's thesis is "Local government spatial plan as environmental normative act". Research on municipal spatial planning as an environmental regulatory enactment is topical, as shortcomings in the legal framework and practice can be identified in the regulatory systems of spatial planning and environmental protection, which affect the state's readiness to effectively face the challenges of modern environmental problems. Recognizing the seriousness of environmental problems, the importance of public rights in the protection of the state of the environment is also growing, because in practice there are various legal problems in ensuring public participation in the spatial planning process. Aim of the work: to research local government spatial plan as a means of regulating environmental protection issues, to identify and analyze the problems of existing regulation and practice in issues where spatial planning and environmental protection interact most closely, to study public rights and their implementation in spatial planning, to offer proposals for elimination or reduction. Tasks: to research the historical formation of the spatial plan and its regulation; to analyze the interaction of spatial planning and environmental protection law regulations in matters of environmental pollution and nature protection; to find out the problems related to the implementation of the right of public participation in the process of territorial planning and the problematic issues of the right to apply to the court; to formulate conclusions and offer solutions in connection with the problem aspects of the implementation of regulatory enactments. The chapters and subchapters of the master's thesis include a review and analysis of the mentioned issues, as well as formulated conclusions and proposals.
