Abstract

Maģistra darba tēma ir “Personas saukšana pie kriminālatbildības aktuālās problēmas”. Maģistra darba mērķis ir noskaidrot ar personas saukšanu pie kriminālatbildības aktuālās problēmas – apsūdzības saturu, apsūdzības izsniegšanu, apsūdzības grozīšanu kriminālprocesa gaitā, principa “tiesības uz aizstāvību” realizēšanu, kā arī sniegt iespējamus risinājumus noskaidrotajiem problēmjautājumiem. Maģistra darbā izvirzītie uzdevumi ir izpētīt un definēt apsūdzības jēdzienu, izpētīt un izprast apsūdzības saturu, izpētīt apsūdzības grozīšanas aspektus kriminālprocesa gaitā. Darbā apskatīti praksē pastāvoši problēmjautājumi saistībā ar apsūdzības saturu, apsūdzības izsniegšanu un apsūdzības grozīšanu, kā arī sniegti iespējami Kriminālprocesa likuma uzlabojumi. The topic of this master’s thesis is “Current problems of the person's prosecution of criminal liability”. The aim of this master’s thesis is to identify current problems regarding a person's prosecution of criminal liability - content of the indictment, indictment, amendment of the charge in the course of criminal proceedings, principle implementation of “the rights of defense”, as well as provide possible solutions to the identified issues. The task set of this master’s thesis is to research and define the concept of accusation, study and understand the content of the indictment, define the aspects pertaining to the amendment of the prosecution during the criminal proceedings. During the course of research, the existing problems regarding the content of the indictment, issuing of an indictment and amendment of the charge were examined. Potential improvements to the Criminal Law were identified and evaluated. Key words: The decision to prosecute a person of criminal liability, indictment, amendment of the charge, the rights of defense.
