Bakalaura darbā tiek pētīts noziedzīgs nodarījums – izvairīšanās no nodokļu un tiem pielīdzināto maksājumu nomaksas. Darba mērķis ir noskaidrot normatīvajos aktos paredzētās atbildības par izvairīšanos no nodokļu un tiem pielīdzināto maksājumu nomaksas priekšnoteikumus, analizēt neseno normatīvo aktu grozījumus kā arī sniegt ieteikumus normatīvo aktu uzlabojumiem. Darbs sastāv no trim nodaļām. Pirmajā nodaļā tiks vispārēji apskatīta normatīvajos aktos paredzētā juridiskā atbildība par izvairīšanos no nodokļu un tiem pielīdzināto maksājumu nomaksas, salīdzinot administratīvās atbildības un kriminālatbildības regulējumu attiecībā uz izvairīšanos no nodokļu un tiem pielīdzināto maksājumu nomaksas. Otrajā nodaļā tiks analizēts Krimināllikuma 218. pantā paredzētā noziedzīgā nodarījuma sastāvs (objekts, priekšmets, objektīvā puse, subjekts, subjektīvā puse), padziļināti aprakstot iespējamos noziedzīgā nodarījuma priekšmetus. Savukārt trešā nodaļa ir veltīta nodokļu nomaksas un krāpšanas nodalīšanas analīzei. The study of this Bachelor Thesis is the criminal offence - tax evasion and evasion of equal payments. The objective of this Bachelor Thesis is to determine the preconditions prescribed by the regulatory acts for the liability for tax evasion and evasion of equal payments, to analyse recent amendments to the regulatory acts, as well as to make recommendations for improvements to the regulatory acts. The Bachelor Thesis consists of three chapters. The first chapter is dedicated to general liability for tax evasion and evasion of equal payments, comparison between administrative and criminal liability for tax evasion and evasion of equal payments. In the second chapter the criminal offence elements prescribed by the Article 218 of the Criminal Law (actus reus, mens rea, causation and concurrence) will be analysed, with an emphasis on analysis of actus reus. And the third chapter will focus on differences between tax evasion and fraud.
