Bāriņtiesu darbība bērna vislabāko interešu uzaugt ģimenē īstenošanā

Abstract

Autore savam bakalaura darbam izvēlējās tēmu “Bāriņtiesu darbība bērna vislabāko interešu uzaugt ģimenē īstenošanā”. Darba pētījuma objekts ir Latvijas Republikas bāriņtiesa un tās rīcība bērna labāko interešu uzaugt ģimenē īstenošanā. Darbā galvenā uzmanība tiek vērsta bāriņtiesu darbībai, kas primāri veidota, lai aizsargātu bērna vislabākās intereses un tiesības. Autore uzskata, ka bērnu labāko interešu aizsardzība ir vissvarīgākais valsts, sabiedrības un pat indivīda uzdevums. Bērnam nav savas autonomijas un iespējas uz neatkarīgu lēmumu pieņemšanu, tādēļ vienmēr bija un būs nepieciešama aprūpes vajadzība no valsts, vecāku un sabiedrības puses. Bērns ir neaizsargāta būtne, tomēr, pateicoties ANO Konvencijai, ir svarīgs tiesību subjekts. Pētījumā tiek secināts, ka bāriņtiesas pienākums ir aizsargāt bērnu no vardarbības un īstenot viņa labākās intereses uzaugt ģimenē. Šobrīd ir pretruna starp bērnu labākām interesēm uzaugt ģimenē un aizsardzību no vardarbības, jo, no vienas puses, bāriņtiesai nepieciešams aizsargāt bērnu tiesības, bet, no otras puses, piešķirtā kompetence izņemt bērnu no ģimenes pieļauj pārkāpt bērnu intereses uzaugt ģimenē. Proti, bāriņtiesās strādā darbinieki, kuriem pietrūkst zināšanu juridiskajā jomā, līdz ar to cieš bērnu labāko interešu aizsardzības sistēmas efektivitāte. Darbā tiek izpētīti Starptautiskie un Latvijas normatīvie akti, aplūkoti zinātnieku pētījumi par bērna tiesību, socializāciju un interešu tēmām. For her bachelor thesis author has chosen the theme “The operation of Orphan’s Courts in the implementation of the best interests of the child to grow up in the family”. The work focuses on the actions of the Orphan’s Courts, which was primarily designed to protect the best interests and rights of the child. The author believes that the protection of the children best interest is the most important task for the state, society and even individual. A child does not have his autonomy and option for making independent decisions, thus needs care from the state, parents, and society. The child is unprotected, but, thanks to the UNO Convention, is important subject of rights. The study concludes that the Orphan's Court has a duty to protect the child from violence and to pursue his or her best interests to be raised in a family, but despite this, there is currently a conflict between the best interests of children to grow up in a family and protection from violence, on the one hand the Orphan’s Court, protecting the child from being abused, takes him out of the family, thus violating the right to have one. Namely, Orphans' courts employ employees who lack knowledge in the legal field, thus the effectiveness of the system for the protection of the best interests of children suffers. The paper examines the international and Latvian normative acts, examines the research of scientists on the topics of children's rights, socialization, and interests.
