dc.description.abstract | Bakalaura darbā “Prokurora priekšraksts par sodu” tiek apskatīts prokurora priekšraksts par sodu kā viens no pirmstiesas kriminālprocesa pabeigšanas veidiem. Darba autore analizējusi prokurora priekšraksta par sodu piemērošanas priekšnoteikumus un specifiku, apskatījusi grozījumu vēsturi un kriminālprocesuālo normu attīstību. Darbā apskatīts ne tikai Latvijas tiesību normu regulējums, bet arī vienkāršotie kriminālprocesa pabeigšanas veidi Baltijā un prokurora priekšraksta par sodu piemērošana Nīderlandē. Bakalaura darba mērķis ir izpētīt prokurora priekšraksta par sodu regulējuma saturu, piemērošanas kārtību un to, vai pastāvošais kriminālprocesuālais regulējums efektīvi nodrošina procesuālās ekonomijas principa ievērošanu. Pētījuma rezultātā autore secina, ka prokurora priekšraksts par sodu veiksmīgi nodrošina procesuālās ekonomijas principu, tiek vienkāršots kriminālprocess un, to piemērojot, ar katru gadu arvien vairāk tiek atvieglota tiesu instance. Tiek secināts, ka likuma regulējums tiek sistemātiski paplašināts un pilnveidots, tomēr darbā akcentētas vēl joprojām esošās neskaidrības un nepilnības prokurora priekšraksta par sodu piemērošanas kārtībā. | |
dc.description.abstract | In the bachlor’s thesis “Prosecutor’s prescription for punishment” are examined prosecutor’s prescription for punishment as one of the ways of completing the pre-trial process. The author analysed preconditions and special features for prosecutor’s prescription for punishment to be applied, studies amendments to the criminal procedure law and development of regulatory framework. In this bachlor’s thesis author studies regulatory framework in Latvia, prosecutor’s prescription for punishment application in Netherland and also view simplified forms of criminal proceedings in other Baltic countries. The aim of the bachelor’s thesis is to explore regulatory framework of prosecutor’s prescription for punishment, application arrangements and if existing regulation of criminal procedure effectively ensures the observance of the principle of procedural economy. As a result of the research, the author concludes that the prosecutor’s prescription for punishment successfully ensures the principle of procedural economy, the criminal procedure is simplified and by applying it, the court instance is more and more facilitated every year. It’s concluded that the regulation of the law is systematically expanded and improved, however, this bachlor’s thesis emphasizes still existing confusion and flaws of the procedure for applying the prosecutor’s prescription on punishment. | |
