Procesa par noziedzīgi iegūtu mantu problemātika kriminālprocesā

Abstract

Bakalaura darba tēma ir “Procesa par noziedzīgi iegūtu mantu problemātika kriminālprocesā”. Bakalaura darba mērķis ir noskaidrot, vai no Krimināllikuma un Kriminālprocesa likuma normām izrietošais process par noziedzīgi iegūtu mantu nodrošina aizskartās mantas īpašniekam tiesības uz efektīviem aizsardzības līdzekļiem un taisnīgu tiesu. Bakalaura darba uzdevumi ir izpētīt noziedzīgi iegūtas mantas jēdzienu un izpratni, analizēt noziedzīgi iegūtas mantas procesa īpatnības, tajā skaitā aizskartās mantas īpašnieka procesuālo statusu un šīs personas tiesības, kā arī noskaidrot, vai Latvijā pastāvošais process par noziedzīgi iegūtu mantu atbilst Eiropas Savienības un starptautisko normatīvo aktu prasībām. Bakalaura darba ietvaros autors sniedz priekšlikumus tiesiskā regulējuma pilnveidošanai, nolūkā nodrošināt indivīda pamattiesības uz īpašumu un taisnīgu tiesu.

The topic of the bachelor's thesis is “Problems of the proceedings regarding criminally acquired property in criminal procedure”. The aim of the bachelor's thesis is to find out whether the process of criminally obtained property arising from the Criminal Law and the Criminal Procedure Law provides the owner of the infringed property with the right to effective remedies and a fair trial. The tasks of the bachelor's thesis are to study the concept and understanding of criminally obtained property, to analyse the peculiarities of the criminally obtained property process, including the procedural status of the owner of the infringed property and the rights and obligations of this person. Within the framework of the bachelor's thesis, the author provides proposals for the improvement of the legal framework in order to ensure the fundamental right of an individual to property and a fair trial.
