Satversmes tiesas ietekme uz pakalpojumu sniedzēja un klientu attiecībām dabasgāzes lietošanas noteikumu pārkāpumu gadījumos.

Abstract

Maģistra darbs “Satversmes tiesas ietekme uz pakalpojumu sniedzēja un klientu attiecībām dabasgāzes lietošanas noteikumu pārkāpumu gadījumos” ir uzrakstīts Latvijas Universitātes Juridiskās fakultātes Civiltiesisko zinātņu katedrā, studiju programmas “Tiesības un organizāciju pārvaldība” ietvaros. Autore maģistra darbā ir izpētījusi normatīvo aktu regulējumu saistībā ar dabasgāzes lietošanas noteikumu pārkāpšanu, kā arī dabasgāzes tirgus atvēršanas radītos izaicinājumus. Maģistra darba mērķis ir analizēt un noskaidrot Satversmes tiesas spriedumu ietekmi uz dabasgāzes pakalpojumu sniedzēja un klientu attiecībām šajā jomā. Maģistra darba rezultātā secināts, ka tieši Satversmes tiesas spriedums lietā Nr.2021-03-03 būtiski mainījis gan dabasgāzes pakalpojumu sniedzēju savstarpējās attiecības atbildības jautājumā, gan attiecības ar klientiem, gan kaitējuma pierādīšanas kartību dabasgāzes lietošanas noteikumu pārkāpumu gadījumā.

The master's thesis “The Influence of the Constitutional Court on the Relationship between a Service Provider and Customers in Cases of Natural Gas Use Regulation violations” is written at the Department of Civil Law, Faculty of Law, University of Latvia, within the study program “Law and Organizational Management”. In the master's thesis, the author has studied the regulation of regulatory enactments regarding the violation of natural gas use regulations, as well as the challenges caused by the opening of the natural gas market. The aim of the master's thesis is to analyze and clarify the impact of the Judgments of the Constitutional Court on the relations between the natural gas service provider and customers in this field. As a result of the Master's thesis, it has been concluded that the Judgment of the Constitutional Court in case No. 2021-03-03 has changed both the mutual relations of natural gas service providers in the issue of liability, the relations with customers, and the procedure for proving damage in case of violations of the natural gas use regulations.
