Patentmeklējums Eiropas patentu iestādē Latvijā pieteiktiem izgudrojumu patentu pieteikumiem.

Abstract

Maģistra darbā ir analizēts Latvijas Republikas Patentu valdes un Eiropas Patentu iestādes nodrošinātā projekta patentmeklējumu saturs un rezultāti. Darba mērķis ir piedāvāt scenārijus patentu piešķiršanas procedūru izmaiņām Latvijā, lai paaugstinātu nacionālajā procedūrā piešķirto patentu vērtību. Pirmajā darba daļā izklāstīta esošā situācija Latvijā, aprakstīta Patentu valdes iesaiste projektā un veicamās darbības, kā arī analizēta pieteicēju interese un patentpilnvarnieku iesaiste. Otrajā darba daļā ir analizēta patentmeklējuma ekspertīze Eiropas patentu iestādē, izklāstīts patentmeklējuma saturs un izvērtējamie kritēriji. Apkopoti un analizēti patentmeklējumu ziņojumi un rakstiskie atzinumi. Trešajā daļā pētīta pieteicēju rīcība pēc patentmeklējumu rezultātu saņemšanas. Darbā sniegti priekšlikumi patentu piešķiršanas procedūru izmaiņām.

The content of the master’s thesis is devoted to conduct the analysis of the content and results of the patent searches of the project provided by the Patent Office of the Republic of Latvia and the European Patent Office. The aim of the study is to offer scenarios for changes in patent granting procedures in Latvia in order to increase the value of patents granted in the national procedure. The first part of the work outlines the current situation in Latvia, in addition it describes the involvement of the Patent Office in the project and the activities to be performed, as well as analyzes the interest of applicants and the involvement of patent attorneys. The second part of the work analyzes the search expertise performed by the European Patent Office, outlines the content of the search and the criteria to be evaluated. Patent search reports and written opinions were compiled and analyzed. The third part examines the action of applicants after receiving the results of patent searches. The paper presents proposals for changes in patenting procedures.
