Arvien vairāk aktualizējoties jautājumam par azartspēļu negatīvo ietekmi, ir novērojama valsts reakcija, veicot pasākumus, lai mazinātu azartspēļu kaitējumu cilvēkiem. Šiem pasākumiem ir ne tikai politiska, bet arī juridiska dimensija, par kuru parasti runā, pārbaudot, vai valsts ir ievērojusi tai noteikto pienākumu atturēties no iejaukšanās personu tiesībās. Analizējot nacionālās un starptautiskās tiesību normas, kā arī pievēršoties zinātnes atziņām par azartspēļu negatīvo ietekmi, darbā tiek pētīts, vai valstij, pamatojoties uz cilvēku tiesībām uz veselību un sociāli atbildīgas valsts principu, ir konstitucionāls pienākums veikt regulējošus pasākumus azartspēļu jomā. Piedāvājot apstiprinošu atbildi uz šo jautājumu, autors sniedz savu redzējumu par to, vai Latvijas valsts šo pienākumu ir pienācīgi izpildījusi. Increasing awareness of the negative impact of gambling has led to a response from the State by taking measures to reduce gambling harm to people. These measures have not only a political but also a legal dimension, which is usually discussed when examining whether the State has complied with its obligation to refrain from interfering with the rights of individuals. By analysing national and international legal norms, as well as by considering scientific findings on the negative effects of gambling, the author discusses whether the State, based on the human right to health and the principle of welfare state, has a constitutional obligation to take regulatory measures on gambling. By offering an affirmative answer to this question, the author gives his view as to whether the State of Latvia has duly fulfilled this obligation.
