Abstract

Bakalaura darba tēma ir ‟Laulības līguma tiesiskais ietvars un tā mijiedarbība ar mantojuma līgumu”. Zinātniskajā darbā izpētītas laulāto līgumiskās mantiskās attiecības un situācijas, kad laulības līgumā ietverts novēlējums nāves gadījumā. Darbā izmantoti teorētiskie aspekti, pētīta vēsture, salīdzinot to ar mūsdienām un šobrīd spēkā esošo regulējumu un praksi. Pētījuma mērķis pārbaudīt praksē esošās problēmsituācijas, kas izriet no laulības līgumā ietverta novēlējuma nāves gadījumā, attiecībā pret trešajām personām, neatraidāmiem mantiniekiem un citiem potenciālajiem mantiniekiem. Tāpat darbā apskatītas mantinieka tiesības un iespējas situācijās, kad laulības līgums ir kļuvis par mantojuma līgumu un skar viņa mantiskās intereses. Darbā autore apskatījusi variantus, kā risināt minētās situācijas un piedāvājusi savus secinājumus un noformulējusi priekšlikumus, tajā skaitā tāda laulības līguma ierakstīšanas zemesgrāmatās, kas satur novēlējumu nāves gadījumā un skar nekustamo īpašumu. The subject of the bachelor's paper is “Legal Framework for the Marriage Contract and its Interaction with the Inheritance Contract”. The scientific work examines the contractual property relations of spouses and the situations in which the marriage contract includes a death bequest. The theoretical aspects are used in the bachelor’s paper, as well as history was studied compared to current and existing regulations and practices. The purpose of the study is to examine the problem situations in practice arising from the death bequest included in the marriage contract in relation to third parties, heirs entitled to preferential share and other potential heirs. The work also studies the rights and opportunities of the heir in situations where the marriage contract has become an inheritance contract and affects the heir’s property interests. The author has examined a number of options for dealing with these situations and has offered her conclusions and formulated proposals, including the registration of a marriage contract containing a death bequest and affecting real estate in the Land Register.
