Cietušā institūts administratīvā pārkāpuma procesā

Abstract

Bakalaura darbā „Cietušā institūts administratīvā pārkāpuma procesā” tiek pētīts administratīvo pārkāpumu tiesībās iekļautā cietušā institūta regulējums Latvijā un piemērošanas problemātika iestāžu praksē. Bakalaura darbā tiek aplūkots un analizēts cietušā institūta regulējums Latvijas Administratīvo pārkāpumu kodeksa darbības laikā un Administratīvās atbildības likumā. Darbā tiek aplūkota iestāžu prakse cietušā institūta piemērošanā un ar to saistītā problemātika personas, kurai administratīvā pārkāpuma rezultātā radīts kaitējums, identificēšanā, cietušā statusa noteikšanā un cietušā tiesību realizēšanā, kā arī ieteikti iespējamie problēmu risinājumi. Darbā tiek analizēta cietušā institūta lietderība un nepieciešamība administratīvo pārkāpumu tiesībās.

In bachelor thesis “The institute of the victim in the administrative offence process” the regulation of the victim’s institute included in laws of administrative offences in Latvia and the problems of its application in the practices of institutions are studied. The regulation of the victim's institute during the operation of the Latvian Code of Administrative Violations and the Law on Administrative Liability are being looked at in the bachelor's thesis. The paper examines the practices of institutions in the application of the victim 's institute and the related problems in identifying the person who has suffered damages as a result of an administrative offence, determining the victim' s status and enforcing the victim 's rights, as well as suggests possible solutions to the problems. The paper analyzes the usefulness and necessity of the victim's institute in the laws of administrative offences.
