Valsts robežas nelikumīgas šķērsošanas krimināltiesiskie aspekti

Abstract

Valsts robeža ir viens no būtiskākajiem faktoriem, kas apliecina tās neatkarību. Valsts robežas nelikumīga šķērsošana uzskatāma par draudu gan sabiedrībai, gan valsts drošībai kopumā. Pastāvot arvien jauniem ģeopolitiskiem izaicinājumiem, ievērojami pieaug noziedzīgu nodarījumu skaits, kas saistās ar valsts nelikumīgu šķērsošanu, tāpēc būtiski izvērtēt spēkā esošā normatīvā regulējuma efektivitāti un piedāvāt jaunus priekšlikumus valsts un sabiedrības drošības garantēšanai. Pētījuma galvenie uzdevumi ir krimināltiesiskā regulējuma vēsturiskās attīstības izpēte, kā arī Krimināllikuma 284. pantā noteiktā noziedzīga nodarījuma sastāva analīze un tā piemērošanas problēmu konstatēšana praksē, papildus izvērtējot valsts robežas nelikumīgas šķērsošanas tiesiskos aspektus ārvalstīs. The state border is one of the most important factors confirming its independence. Illegal crossing of the state border is considered a threat to both society and national security in general. In the face of ever-evolving geopolitical challenges, the number of criminal offenses related to illegal crossing of the state border is significantly increasing, therefore it is important to evaluate the effectiveness of the existing regulatory framework and offer new proposals to guarantee state and public security. The main tasks of the research are to study the historical development of the criminal law regulation, as well as to analyse the composition of the criminal offense specified in Section 284 of the Criminal Law and to identify the problems of its application in practice, additionally evaluating legal aspects of illegal crossing of the state boarder in other countries abroad.
