Mikrolieguma kompensācijas problemātika "Zaļā kursa" ietvaros

Abstract

Lai sasniegtu Parīzes nolīguma ambiciozos klimatneitralitātes mērķus, Eiropas Savienības līmenī deklarēts Eiropas Zaļais kurss, savukārt Latvijas Republikā, kā papildus instruments bioloģiskās daudzveidības nodrošinājumam, tiek realizēts mikrolieguma institūts. Pētnieciskajā darbā “Mikroliegumu kompensācijas problemātika “Zaļā kursa” ietvaros” aplūkota mikroliegumu kompensāciju problemātika, analizēts Latvijas Republikas Zaļā kursa ietvaros ieviestais meža nozares un vides politikas normatīvais regulējums, aplūkoti analogie Eiropas Savienības dalībvalstu tiesību akti. Patreizējais mikroliegumu normatīvais regulējums kompensāciju mehānisma kontekstā nav atbilstošs “taisnīga atlīdzinājuma” izpratnei, kas definēta judikatūrā un tiesību doktrīnās Latvijas Republikā, Vācijas Federatīvajā Republikā un Somijas Republikā, tas ir radījis situāciju, kurā meža īpašniekam nesamērīgi ierobežotas subjektīvās tiesības uz īpašumu un bioloģisko aktīvu jeb dabisko augļu izmantošanu. Bakalaura darba ietvaros ir izstrādāti priekšlikumi Ministru kabineta noteikumos Nr.891 “Noteikumi par saimnieciskās darbības ierobežojumiem, par kuriem pienākas kompensācija, tās izmaksas nosacījumiem, kārtību un apmēru” veicamajiem grozījumiem, lai panāktu līdzsvarotas attiecības starp vidi, ekonomiku un sabiedrību, kā arī, lai radītu taisnīgas atlīdzības kompensāciju mehānismu meža īpašniekiem gadījumos, kad to pamattiesības ir ierobežotas mikrolieguma gadījumā. Latvijas Republikas vides tiesību aktos ieviešams alternatīva rakstura kompensējošais mehānisms mikroliegumu institūtā - īpašuma atsavinājums sabiedrības vajadzībām, kas iekļaujas Eiropas Zaļā kursa tvērumā par solidāro atbildību pret dabas bioloģisko daudzveidību.

To achieve the ambitions of the European Climate Pact, the European Union has declared the Green Deal, while in the Republic of Latvia the micro-reserves operate as an additional instrument to preserve biological diversity. The bachelor’s thesis “The problem of micro-reserves compensations in the context of the Green Deal” includes research on the problems of compensations in the micro-reserves, analysis of the regulatory acts of forestry and environmental policy in the Republic of Latvia and summary of the related regulatory acts in the European Union member states. The current micro-reserves compensation mechanisms do not comply with the understanding of the ‘fair refund’ defined in the legislation and regulatory acts in the Republic of Latvia, the Federal Republic of Germany, and the Republic of Finland. It allows the situation, where the forest owners have their subjective rights on the use of their property and biological assets unfairly limited. Within the bachelor’s thesis the proposal of several amendments to the Regulations of the Cabinet of Ministers nr.891 ‘On Restrictions of Economic Activities, eligible for compensation and its payment conditions, procedures and scope’, to balance the responsibilities for the environment, economy and society, and to provide a fair compensation mechanisms to the forest owners in case of the restriction of their activities within the micro-reserves. In the environmental legislation of the Republic of Latvia an alternative compensation mechanism in the micro-reserves should be introduced – the alienation of property necessary for public needs, declared by the European Green Deal on solidarity and responsibility for the biological diversity of the nature.
