Noziedzīgi nodarījumi maksātnespējas jomā

Abstract

Mūsdienu nestabilajos apstākļos, maksātnespējas institūts ieņems vēl nozīmīgāku lomu. Būtiski ir nošķirt komerciālu neveiksmi no personas apzinātas rīcības, kas vērsta uz situācijas ļaunprātīgu izmantošanu. Atbildība par noziedzīgiem nodarījumiem maksātnespējas jomā regulēta Krimināllikuma 213.pantā (novešana līdz maksātnespējai), 214.pantā (nepatiesa maksātnespējas procesa pieteikuma iesniegšana) un 215.pantā (maksātnespējas procesa kavēšana). Darba mērķis ir izpētīt noziedzīgu nodarījumu maksātnespējas jomā sastāva pazīmes, tostarp tiesu praksē novēroto problemātiku, kas saistīta ar sastāva pazīmju konstatēšanu. Darbā autore pēta tiesisko regulējumu, analizē noziedzīgo nodarījumu sastāva objektīvās un subjektīvās pazīmes, salīdzina ārvalstu krimināltiesisko regulējumu maksātnespējas jomā.

In today's inconstant circumstances, the institute of insolvency will play an even more important role. It is essential to separate a commercial failure from a person's deliberate action aimed at abuse. Liability for criminal offenses in the field of insolvency is regulated in Section 213 (driving into insolvency), Section 214 (submission of a false application for insolvency) and Section 215 (delay of insolvency proceedings) of the Latvian Criminal Law. The aim of the work is to study the composition features of insolvency offenses, including the problems observed in case law related to the identification of composition features. The author studies the legal regulation, analyzes the objective and subjective features of the composition of criminal offenses, compares the foreign criminal regulation in the field of insolvency.
