Aizliegto preču pārvietošana pār Eiropas Savienības robežu

Abstract

Aizliegto preču, ievešana un pārvietošana caur Eiropas Savienības teritoriju, ir aktuāla problēma. Autores mērķis ir analizēt noteiktu preču grupu ierobežojumus un aplūkot tiesisko regulējumu. Vai pieļaujama šo preču izvešana atpakaļ uz trešo valsti, muitas maksājumu veikšana un preces laišana brīvā apgrozībā? Jānoskaidro atbildīgās personas, kas ir atbildīgas par muitas noteikumu pārkāpšanu. Kontrafaktas preces drīkst pārvietot tranzītā, ja tās tiek izvestas uz trešo valsti. Precēm ar ierobežojumiem, kas neatbilst Latvijas Republikas normatīvo aktu prasībām, muitas formalitātes tiek veiktas citā dalībvalstī un preces kļūst brīvi pieejamas Eiropas Savienībā. Atbildība par pārkāpumiem tranzīta procedūrā būtu jānosaka arī kravas saņēmējam un nosūtītājam, importa procedūrā galvenajam noteicošajam atbildības faktoram nebūtu jābūt pārstāvniecības veidam.

The import and movement of prohibited goods through the territory of the European Union is a topical problem. The aim of the author is to analyze the restrictions of certain product groups and to look at the legislation. Are these goods allowed to be re-exported to a third country, subject to customs duties and released for free circulation? The persons responsible for the breach of customs rules need to be identified. The counterfact goods may be moved in transit if they are exported to a third country. For goods with restrictions that do not comply with the requirements of the regulatory enactments of the Republic of Latvia, customs formalities are performed in another Member State and the goods become freely available in the European Union. Liability for irregularities in the transit procedure should also be determined by the consignee and the consignor, and the type of representation should not be the main determining factor in the import procedure.
