Satversmē ietverto sabiedrības vērtību saturs un piemērošana

Abstract

Bakalaura darbā analizēts Satversmes ievada piektajā rindkopā ietverto sabiedrības vērtību saturs un piemērošana. Ņemot vērā, ka ne visas Satversmes ievadā ietvertās vērtības ir tiesību normas, rodas aktuāls jautājums, kas reizē arī ir bakalaura darba mērķis – kā nošķirt tās konstitucionālās vērtības, kuras nav juridiski saistošas, no tām konstitucionālajām vērtībām, kuras reizē arī ir tiesību normas? Lai atbildētu uz problēmjautājumu, autors noskaidros konstitucionālo vērtību jēdzienu, to norobežošanu no tiesību normām, kā arī analizēs sabiedrības vērtību juridisko raksturu un to piemērošanu.

In the bachelor’s thesis the author analyses the content and application of the values of society, which are included in the Preamble’s fifth paragraph of the Constitution of the Republic of Latvia. Since not all constitutional values in the Preamble are constitutional rights, the bachelor thesis covers the main problem – how to distinguish between constitutional values, which are not legal norms, from legally binding constitutional rights? To answer this question, the author identifies the concept of constitutional values, analyses their distinction between constitutional rights, and studies the content and application of the values of society.
