Dzīvnieku tiesiskais statuss: tiesībfilozofiskie, vēsturiskie un salīdzināmo tiesību aspekti

Abstract

Dzīvnieku tiesiskais statuss ir pielīdzināms krēsla vai spoguļa tiesiskajam statusam – dzīvnieks ir tiesību objekts. Valstis, kā, piemēram, Vācija, Šveice un Austrija ir noteikušas, ka dzīvnieki nav lietas. Tika pētīta tiesību aktu, kas noteic dzīvnieku tiesisko statusu un aizsardzību, izcelsme un attīstība, analizēti filozofu viedokļi par dzīvnieku būtību. Autore apskatīja valstu tiesisko regulējumu, tos salīdzinot un sniedzot priekšlikumus tiesiskā regulējuma pilnveidei. Pētījuma rezultātā autore noskaidroja, ka ir nepieciešams noteikt, ka dzīvnieks ir justspējīga būtne, ne lieta, pamatojoties uz citu valstu pieredzi, dzīvnieku būtību, tiesiskā regulējuma pilnveidi un cietsirdīgas izturēšanās novēršanu un vides saglabāšanu. The legal status of animals is comparable to the legal status of a chair or mirror - an animal is an object of law. Countries such as Germany, Switzerland and Austria have ruled that animals are not an object. The origin and development of legislation governing the legal status and protection of animals was studied, and philosophers' views on the nature of animals were analyzed. The author looked at the legal framework of other countries, comparing them and making proposals for the improvement of the legal framework. As a result of the research, the author found out that it is necessary to determine that an animal is a sentient being, not an object - based on the experience of other countries, the nature of animals, the need for improvement of the legal framework and the prevention of cruel treatment and environmental protection.
