Bērna tiesības uz identitāti un adopcijas noslēpums

Abstract

Adopcijas process kalpo kā iespēja palīdzēt bērnus nodrošināt ar ģimeni un mājām. Tomēr procesā svarīgākās ir bērna labākās intereses, kas sevī ietver arī bērna tiesības uz identitāti un tās saglabāšanu. Mūsdienās arvien aktuālāks kļūst jautājums par adopciju uz ārzemēm, tās regulējumu un reālo situāciju dzīvē. Tādēļ darbā galvenā apskatītā problēma ir vecāku tiesības uz adopcijas procesa turēšanu noslēpumā un adopcijas noslēpuma mijiedarbība ar bērna tiesībām uz identitāti, bet darba mērķis ir izvērtēt šo abu tiesību līdzsvarošanu. Darba uzdevumi ir pētīt identitātes jēdzienu, apskatīt Eiropas Cilvēktiesību tiesas praksi, kurā ietverta cilvēka tiesības uz identitāti un citas personas tiesības līdzsvarošanas problemātika, analizēt adopcijas procesu un tā regulējumu, apskatīt adopcijas noslēpuma jēdziena būtību un izpētīt adopcijas noslēpuma mijiedarbību ar personas tiesībām uz identitāti. Darbā tiek noskaidrotas adopcijas noslēpuma turēšanas ietekme un sekas attiecībā uz bērna identitāti, šo tiesību līdzsvarošana.

The adoption process serves as an opportunity to help provide children with family and home. However, the best interests of the child are important in the process, which also includes the children’s right to identity and its preservation. Today, the issue of adoption abroad, its regulation and the reality of life is becoming more and more pressing. Therefore, the main problem discussed in the work is the parents’ right to keep the adoption process secret and the reciprocity of the adoption secret with the child's right to identity, but the aim of the work is to assess the balancing of these two rights. The tasks of work are to research the concept of identity, to look at the European Court of Human Rights practice, which includes the right to personal identity and the problem of balancing said right with another person’s rights, to analyse the adoption process and its regulation, to study the nature of the concept of the secret of adoption, and to explore the reciprocity of the secret of adoption with the right to personal identity. The work shall identify the effects and consequences of keeping adoption a secret in relation to the identity of the child and the balancing of both rights.
