Likumdošanas process, kas vēsturiski ir bijis politiskas gribas izpausme, neierobežojot to ar tiesību normām, mūsdienu aktuālo vajadzību un cilvēka, tehnoloģiju un zinātnes attīstības kontekstā, vairs neiederas demokrātiskas tiesiskas valsts tvērumā. Labas likumdošanas princips sekmē, ka tiesību normas pieņemšanas process ne vien atbilst formālajām prasībām, bet arī veicina sabiedrības uzticību valstij un tiesībām. Tas ir racionālāks un pieņemtie lēmumi ir zinātniski pamatoti. Pētījuma mērķis ir vērtēt būtisku procesuālu pārkāpumu kā pamatu tiesību normas atzīšanai par neatbilstošu Latvijas Republikas Satversmei. Pētījuma rezultātā tiek konkretizēti kritēriji, kas ir nozīmīgi, nošķirot būtisku procesuālu pārkāpumu no procesuāla pārkāpuma. Autore sniegusi arī subjektīvo vērtējumu un iespējamos risinājumus likumdošanas procesa kvalitātes uzlabošanai. The procedure of legislation historically has been seen as an expression of the political will, it had no legal framework as a limitation for discretion of legislature. Nowadays, the “political” form of legislation is no more appropriate for a democratic republic because of the current needs and the development of society, technologies and science. The principle of good legislation provides not only the procedure of legislation compatible with the formal requirements, but also promotes the trust of society. On impact of the principle of good legislation, the procedure of legislation becomes more rational and based on scientific knowledge. The purpose of the research is to assess substantial procedural infringements as a ground for recognition of a legal norm as incompatible with Satversme of the Republic of Latvia. In the result of the research there are specified the criteria that are significant to differentiate the substantial procedural infringements and procedural infringements. The author also has proposed her subjective assessment and the possible solutions to improve the quality of the procedure of legislation.
