Viendzimuma pāru tiesiskā regulējuma problemātika

Abstract

Laika gaitā mainās un attīstās daudzas nozares, kuru rezultātā uzlabojas cilvēku dzīves kvalitāte, arī jurisprudence nav izņēmums. Normatīvais regulējums ir dzīvs organisms, kurš attīstās un mainās līdzi ar sabiedrības vērtībām, atspoguļojot sociālo realitāti. Mūsdienu sociālajā realitātē vairs nav vietas noslēgtām stagnātiskām pārliecībām par vienu pareizo ģimenes modeli. Diemžēl Latvija ir viena no nedaudzajām Eiropas valstīm, kur likumdevējs nav pieņēmis tādu ģimenes attiecību tiesisko regulējumu, kas atspoguļotu sociālo realitāti un nodrošinātu dažādu ģimenes modeļu, tai skaitā arī viendzimuma partneru ģimenes juridisku aizsardzību. Šāda Latvijas tiesiskā realitāte liedz viendzimuma partneru ģimenēm iespēju realizēt Satversmes 110.pantā ietvertās sociālās un ekonomiskās tiesības. Bakalaura darba “Viendzimuma pāru tiesību regulējuma problemātika” mērķis ir noskaidrot ģimenes jēdziena izpratni Satversmes 110.panta ietvaros, aplūkot tiesiskā regulējuma aktualitātes attiecībā uz viendzimuma partneru ģimenēm dažādās Eiropas valstīs, tostarp Latvijā, kā arī izpētīt normatīvā regulējuma problemātiku un piedāvāt iespējamos risinājumus viendzimuma pārtneru ģimenēm, kas vēlas realizēt vecāku tiesības, ievērojot bērnu labākās intereses. Darba rezultātā autore secināja, ka atspoguļojot sociālo realitāti, likumdevējam ir jānodrošina viendzimuma partnerattiecību tiesību atzīšanas un aizsargāšanas tiesiskos mehānismus, ne tikai izstrādājot un pieņemot vienu likumu, kur valsts atzītu tādu attiecību reģistrāciju, bet arī veicot attiecīgos grozījumus vai papildinājumus atsevišķu nozaru likumos, lai arī Latvijas homoseksuālie iedzīvotāji kā minoritātes grupa justos vienlīdzīgi un respektēti.

Many industries are changing and evolving over time, leading to an improvement in people's quality of life, and the legal sector is no exception. Normative regulation is a living organism that develops and changes with the values of society, reflecting social reality. In today's social reality, there is no room for closed stagnant beliefs about the right family model. Unfortunately, Latvia is one of the few European countries where the legislator has not adopted a legal framework for family relations that would reflect the social reality and ensure the legal protection of the various family models, including same-sex partners. Such a legal reality in Latvia deprives same-sex partner families of the opportunity to exercise the social and economic rights enshrined in Article 110 of the Satversme. The aim of the bachelor's thesis “Problems of regulation of same-sex couples' rights” is to clarify the concept of family within the framework of Article 110 of the Satversme, to look at topicalities of legal regulation in relation to same-sex partner families and offer the possible solution for same-sex couples, who want to exercise their parental rights in the best interests of their children. As a result of the work, the author concluded that reflecting the social reality, the legislator must ensure legal mechanisms for the recognition and protection of same-sex partnership rights, not only by drafting and adopting a single law recognizing such registration, but also by making appropriate amendments or additions to the laws of certain sectors, in order to make the minority group of the Latvian homosexuals feel equal and respected.
