Eiropas Savienības sankciju attiecināmība uz sankcionētu subjektu kontrolē esošām personām

Abstract

Šī brīža ģeopolitiskās situācijas dēļ Eiropas Savienības līmenī ir ieviests plašs un visaptverošs sankciju regulējums, kas paredz virkni ierobežojumu pret sankciju sarakstos uzskaitītajām fiziskajām un juridiskajām personām. Tomēr, lai nodrošinātu efektīvu sankciju darbību, šos ierobežojumus ir nepieciešams attiecināt arī pret tām personām, caur kurām sankcionētais subjekts var pastarpināti īstenot savas intereses. Tādējādi bakalaura darbā tiek pētīta Eiropas Savienības sankciju jeb ierobežojošo pasākumu attiecināmība uz personām, kas atrodas sankciju sarakstos iekļauto personu kontrolē. Pētījuma ietvaros tiek analizēti normatīvie akti, Eiropas Savienības institūciju un Latvijas kompetento institūciju skaidrojumi un dokumenti, kā arī Eiropas Savienības tiesu prakse, lai tādējādi identificētu kontroles jēdzienu, nošķirtu to no citiem satura ziņā līdzīgiem terminiem un mazinātu praksē pastāvošās kontroles jēdziena interpretācijas neskaidrības. Tāpat bakalaura darba ietvaros tiek vērtētas normatīvajā regulējumā saskatāmās nepilnības sankcionēto subjektu un to kontrolē esošo personu iespējās īstenot savu tiesību un tiesisko interešu aizsardzību, kā arī sniegti vairāki priekšlikumi Eiropas Savienības sankciju režīmu pilnveidošanai. Due to the current geopolitical situation, a broad and comprehensive sanctions regime has been introduced by the European Union, imposing a number of restrictions on the natural and legal persons listed in the sanction’s lists. However, in order to ensure the sanction’s effectiveness, it is necessary to extend those restrictions to persons through whom the sanctioned subject can indirectly pursue its interests. Thus, the bachelor's thesis examines the applicability of the European Union’s sanctions or restrictive measures to persons which are under the control of the directly sanctioned subjects. The study analyses the regulatory enactments, explanations and documents of the European Union institutions and Latvian competent authorities, as well as the case law of the Courts the European Union in order to identify the concept of control, distinguish it from other similar terms and reduce uncertainties in its interpretation. The bachelor's thesis also provides an assessment on the regulatory framework issues in regards to protection of the rights and legal interests of the sanctioned persons and entities under their control. In conclusion, proposals and recommendations are made for the improvement of the European Union’s sanction regimes.
