Bērnu un vecāku personiskās tiesības un pienākumi

Abstract

Bakalaura darba tēma ir bērnu un vecāku personiskās tiesības un pienākumi. Darba autore šo tēmu izvēlējās, jo bērnu un vecāku tiesības un pienākumi ir savstarpēji saistīti, un mijiedarbojoties veido savstarpējas attiecības, kas ir viens no svarīgākajiem faktoriem bērna attīstībā un izaugsmē. Bakalaura darba mērķis ir izpētīt bērnu un vecāku personisko tiesību un pienākumu regulējumu starptautiskajos tiesību aktos un šo tiesību un pienākumu tvērumu Latvijas Republikas normatīvajos aktos. Bakalaura darbā sniegts izklāsts un analizētas bērnu pamattiesības un pamatbrīvības, raksturots aizgādības tiesību jēdziens un tā sastāvdaļas. Bakalaura darbā padziļināti analizēti bērnu un vecāku saskarsmes tiesību pamatprincipi un problemātika, vērtēta bāriņtiesas nozīme un funkcijas bērna tiesību un interešu aizsardzībā, kā arī analizēta bērna labāko interešu principa ievērošana un nozīmība. Bakalaura darbā tiek secināts, ka normatīvā regulējuma bāze Latvijā bērnu tiesību aizsardzības nodrošināšanā ir visaptveroša un pietiekoši laba, taču nepieciešams veicināt normatīvā regulējuma izpratni un ievērošanu, stiprinot ne tikai sabiedrības un dažādu institūciju atbildību, bet īpaši uzsverot un atgādinot tieši vecāku un ģimenes atbildību par bērnu tiesību aizsardzību.

Bachelor thesis topic is personal rights and responsibilities of parents and children. The author chose this topic because the rights and responsibilities of children and parents are interrelated, and interact to form a relationship, which is one of the most important factors in a child's development and growth. The aim of the bachelor's thesis is to study the regulation of personal rights and obligations of children and parents in international legal acts and the scope of these rights and obligations in the regulatory enactments of the Republic of Latvia. The bachelor's thesis presents and analyzes the fundamental rights and freedoms of children, describes the concept of custody and its components. The basic principles and problems of children's and parents' access rights are analyzed in depth in the bachelor's thesis, the role and functions of the Orphan's Court in the protection of the child's rights and interests are assessed, as well as the observance and significance of the child's best interests. The bachelor's thesis concludes that the regulatory framework in Latvia for the protection of children's rights is comprehensive and good enough, but it is necessary to promote understanding and compliance with the regulatory framework, strengthening not only the responsibility of society and various institutions, but especially emphasizing and reminding parents and families protection of human rights.
