Sadalīšana dzīvokļu īpašumos kā kopīpašuma izbeigšanas veids daudzīvokļu mājā

Abstract

2022.gada 1.maijā spēkā stājās Civillikuma grozījumi, nosakot, ka kopīpašumu var izbeigt ar tā sadalīšanu dzīvokļa īpašumos. Tomēr nav iespējams paredzēt, kā šāds kopīpašuma izbeigšanas veids darbosies praktiski. Bakalaura darbā “Sadalīšana dzīvokļu īpašumos kā kopīpašuma izbeigšanas veids daudzdzīvokļu mājā” tiek aplūkots kopīpašuma institūts, kā arī modelēts, kā sadalīšana dzīvokļu īpašumos varētu izpausties praktiski. Tāpat tiek pētīts, kādiem priekšnosacījumiem ir jāpastāv, lai kopīpašumu izbeigtu, sadalot to dzīvokļu īpašumos. Darba nobeigumā tiek secināts, ka paredzētie grozījumi, kaut gan atvieglos tos tiesas procesus, kuros tiek lūgta kopīpašuma sadalīšana dzīvokļu īpašumos, netiks rasinātas tās problēmas, kas var rasties ar šādu sadalīšanu, turklāt grozījumi ir nepilnīgi attiecībā uz citām ēkām.

On 1st of May 2022, amendments to the Civil Law entered into force, stipulating that joint property can be terminated by its division into apartment properties. However, it is not possible to predict how this type of termination of joint property will work in practice. In the bachelor’s thesis “Division into apartment properties as a way of terminating joint ownership in an apartment house” the institute of joint property is looked at, as well as modelled how the division into apartment properties could work in practice. It is also being studied what preconditions must be met for the termination of joint ownership in apartment houses to work. In the conclusion of the work, it is concluded that although the proposed amendments will facilitate those court proceedings in which the division of joint property in apartment properties is requested, they will not address the problems that may arise from such a division, and the amendments are incomplete for other buildings.
