Ar lietas vešanu saistīto izdevumu atlīdzināšana lietas dalībniekiem civilprocesā

Abstract

Bakalaura darba tēma ir “Ar lietas vešanu saistīto izdevumu atlīdzināšana lietas dalībniekiem civilprocesā”. Tiesāšanās izdevumi, tai skaitā ar lietas vešanu saistītie izdevumi civilprocesā ierobežo Satversmē garantētās personas tiesības aizstāvēt savas tiesības un intereses taisnīgā tiesā. Laikam ejot, attīstoties tehnoloģijām un mainoties paradumiem, ir nepieciešams modernizēt Civilprocesa likuma regulējumu, lai padarītu tiesu pieejamāku un pēc iespējas mazāk ierobežotu personu intereses. Bakalaura darba mērķis ir izpētīt ar lietas vešanu saistīto izdevumu atlīdzināšanu lietas dalībniekiem civilprocesā un sniegt priekšlikumus normatīvā regulējuma pilnveidošanai. Bakalaura darba rezultātā autore konstatē problēmas spēkā esošajā regulējumā un izsaka priekšlikumus veikt grozījumus Civilprocesa likuma 44.pantā un izdot jaunus Ministru kabineta noteikumos.

Theme of bachelor thesis is “Reimbursment of costs related to the proceedings to the parties in civil proceedings”. Costs of adjudication, including expenses related to the conduct of a case in civil proceedings, restrict the right of a person guaranteed by the Satversme to defend his or her rights and interests in a fair court. As time goes on, with the development of technology and changing habits, it is necessary to modernize the regulation of the Civil Procedure Law in order to make the interests of the judiciary more accessible and as little as possible restricted. The aim of the bachelor's thesis is to study the reimbursement of costs related to the conduct of the case to the participants in the case in civil proceedings and to provide proposals for the improvement of the regulatory framework. As a result of the bachelor's thesis, the author identifies problems in the current regulation and makes proposals to make amendments to Article 44 of the Civil Procedure Law and to issue new regulations of the Cabinet of Ministers.
