Vecāku atvaļinājuma nenododamās daļas ieviešanas aspekti saskaņā ar Eiropas Parlamenta un Padomes direktīvu 2019/1158

Abstract

Bakalaura darba mērķis ir analizēt vecāku atvaļinājuma nenododamās daļas ieviešanas aspektus Latvijas nacionālajā tiesību sistēmā. Līdz šim vecāku atvaļinājuma nenododamo daļu visas dalībvalstis nav ieviesušas, kā arī daļā no tām vecāku atvaļinājuma regulējums nav motivējošs, lai veicinātu abus vecākus uzņemties vienādas rūpes par bērnu pēc tā dzimšanas. Līdz ar to darbā tiks pētīts tas, vai pieņemto normatīvo aktu grozījumi atbildīs Direktīvas 2019/1158 mērķim – veicināt darba un privātās dzīves līdzsvara nodrošināšanu sievietēm un vīriešiem. Tostarp darbā tiks analizēti arī ar vecāku atvaļinājumu saistītie tiesību institūti un principi.

The aim of the bachelor's thesis is to analyze the implementation aspects of the non-transferable part of parental leave in the national legal system of Latvia. To date, the non-transferable part of parental leave has not been introduced in all Member States, and in some of them the regulation of parental leave is not an incentive to encourage both parents to take equal care of their child after birth. Consequently, the study will examine whether the amendments to the adopted legislation will meet the objective of Directive 2019/1158 - to promote work-life balance for women and men. Among other things, the legal institutes and principles related to parental leave will be analysed in the work.
