Ieslodzīto tiesības uz sadzīves apstākļiem un uzturu

Abstract

Bakalaura darbā tiek pētīti ieslodzīto uztura, higiēnas, platības sadzīves apstākļi Latvijas ieslodzījuma vietās. Bakalaura darba mērķis ir pētīt sadzīves apstākļu ietekmi uz ieslodzīto; normatīvo regulējumu Latvijā attiecībā uz ieslodzīto tiesībām uz uzturu, higiēnu, telpu; sadzīves apstākļu nodrošināšanu; noskaidrot, nepieciešamību pamatot reliģiskā uztura nodrošināšanu; specifiskā uztura saņemšanas iespējas; kā tiek veikts novērtējums ieslodzīto kameras platības atbilstībai. Lai sasniegtu bakalaura darba mērķi, darba autors izvirza šādus uzdevumus: 1)analizēt Latvijas Republikas tiesu un Eiropas Cilvēktiesību tiesas praksi; 2)analizēt Latvijas Republikas un ārvalstu normatīvo regulējumu; 3)analizēt literatūru, kas veltīta sadzīves apstākļu problemātikai ieslodzījuma vietās. Bakalaura darbā tika secināts, ka ieslodzītajiem, lūdzot reliģijai atbilstošu uzturu, tas ir jāpamato; lai noteiktu ieslodzījuma kameras platības pārkāpumu Eiropas Cilvēktiesību un pamatbrīvības konvencijas 3. panta kontekstā nepieciešams vērtēt arī citus ieslodzījuma apstākļus; sadzīves apstākļiem var pastāvēt ietekme uz ieslodzīto veselību, korekciju, rehabilitāciju; būtu nepieciešams precizēt atsevišķas ieslodzīto sadzīves apstākļu normas. The bachelor's thesis studies the nutritional, hygiene and living conditions of prisoners in Latvian prisons. The aim of the bachelor's thesis is to study the impact of living conditions on the prisoner; the regulatory framework in Latvia regarding the rights of prisoners to food, hygiene and premises; provision of living conditions; to find out the necessity to substantiate the provision of religious nutrition; opportunities to receive specific nutrition; how the adequacy of the prisoner's cell area is assessed. In order to achieve the goal of the bachelor's thesis, the author sets the following tasks: 1) to analyze the practice of the courts of the Republic of Latvia and the European Court of Human Rights; 2) to analyze the regulatory framework of the Republic of Latvia and foreign countries; 3) to analyze the literature dedicated to the problems of living conditions in prisons. The bachelor's thesis concluded that prisoners, when requesting religiously appropriate nutrition, must justify this; in order to determine the violation of the area of the prison cell, it is necessary to assess other conditions of imprisonment in the context of Article 3 of the European Convention on Human Rights and Fundamental Freedoms; living conditions may have an impact on the health, correction and rehabilitation of prisoners; it would be necessary to clarify certain norms of living conditions of prisoners.
