Krimināllietu izskatīšana rakstveida procesā Covid-19 izplatības ierobežojumu laikā

Abstract

Lai mazinātu tiesu noslodzi un lietu izskatīšanas termiņus, likumdevējs Kriminālprocesa likumā ir noteicis gadījumus, kad tiesas var pieņemt lēmumu par lietas izskatīšanu rakstveida procesā. Tomēr laikā, kad valstī ar vien vairāk sāka izplatīties Covid-19 infekcija, likumdevējam nācās noteikt papildus gadījumus, kad tiesas var lemt par lietas izskatīšanu rakstveidā. Tāpēc darba izstrādes mērķis ir noskaidrot, kādus papildus gadījumus, kad lietu ir iespējams izskatīt rakstviedā, likumdevējs ir noteicis speciālajos noteikumos, vai šie noteikumi ietekmē personas tiesības uz lietas izskatīšanu mutvārdu procesā, kā arī, vai Kriminālprocesa likumā būtu pieļaujams veikt grozījumus un iekļaut speciālo regulējumu noteikumus. Lai sasniegtu darbam izvirzīto mērķi, nepieciešams ir iepazīties ar Kriminālprocesa likumā un speciālajos noteikumos iekļautajiem gadījumiem, kad tiesas var noteikt lietas izskatīšanu rakstveida procesā; veikt secinājumus par regulējumu ietekmi uz personas tiesībām uz lietas izskatīšanu mutvārdu procesā; pamatojoties uz secinājumiem, apsvērt nākotnes regulējuma iespējas. Darba izstrādes procesā tiek secināts, ka, nosakot speciālajos noteikumos papildus gadījumus, kad tiesas var pieņemt lēmumu par lietas izskatīšanu rakstveida procesā, personas tiesības uz lietas izskatīšanu mutvārdu procesā netiek ietekmētas, jo likumdevējs ir papildus noteicis personām tiesības iebilst pret lietas izskatīšanu rakstveida procesā, kā arī iebilst un iesniegt viedokļus ar spriedumu saistītiem jautājumiem.

To reduce the pressure on the court system and case review terms, legislators in the Criminal procedure law have identified exceptions when the court can make a judgment on the examination of the case in a written procedure. Nevertheless, in times when Covid-19 infection is spreading in the country, legislators had to adopt additional exceptions when the court can make a judgment based on the examination of the case in a written procedure. Therefore, the aim of this thesis is to find out and examine what additional exceptions, when the case can be judged in written procedure, the legislators have specified in the special regulations, whether these additional regulations affect a persons right to an oral hearing, as well as whether it would be permissable to amend and include special regulations in the Criminal Procedure Law. In order to achieve the aim of this thesis, it is necessary to get acquainted with the cases included in the Criminal Procedure Law and special regulations, when the courts may order the hearing of a case in the written procedure; to draw conclusions regarding the impact on a persons right to an oral hearing; consider future regulatory options based on the findings of this thesis. In the process of drafting this thesis, it is concluded that by determining additional cases in the special regulation when courts may decide to hear a case in a written procedure, a persons right to an oral hearing is not affected, as the legislator has additionally determined the right to object to hearing in written proceedings, as well as object and submit observations on matters related to the judgment.
