Tiesības uz izteiksmes brīvību ietvars attiecībā uz dezinformācijas izpaušanu par Covid-19

Abstract

Covid-19 pandēmijas ietvaros aktualizētā ‘infodēmija’, kuras norises brīdī izteiksmes brīvības ietvarā tiek izplatīta maldinoša informācija ļaunprātīgos un savtīgos nolūkos, rada nepieciešamību izstrādāt tiesisko regulējumu un līdzekļus tās rezultātā radītā un potenciālā kaitējuma novēršanai, kas nepārkāpj cilvēku tiesības uz izteiksmes brīvību. Autors darbā analizē dezinformācijas jēdzienu, izteiksmes brīvības un attiecīgi Covid-19 dezinformācijas ierobežošanas tiesisko pamatotību, ierobežošanas tendences starptautiskajā un nacionālajā līmenī. Bakalaura darba autors ir izvirzījis šādu darba mērķi – analizēt aktuālo Covid-19 dezinformācijas ierobežošanas mēģinājumu piemērotību un problemātiku tiesību uz izteiksmes brīvību kontekstā. Bakalaura darba noslēgumā autors izvirza secinājumus par Covid-19 dezinformācijas ierobežošanas problemātiku, izceļot konstatētās noregulēšanas priekšrocības un trūkumus.

The “infodemic” that has been topicalized during the Covid-19 pandemic, within which misleading information is being spread for both malicious and selfish intent, has created a necessity to create legal regulations and mechanisms to prevent the harm and the potential to harm caused by its effects in a manner that does not violate the right to freedom of expression. Within the thesis, the author analyses the concept of disinformation, the legal justifications for restricting freedom of expression and accordingly – Covid-19 disinformation, the tendencies of restricting the aforementioned information in the national and international levels. The author of the bachelor’s thesis has set the following aim – to analyze the suitability and problems related to currently relevant attempts at restricting Covid-19 disinformation in the context of freedom of expression. The author concludes the bachelor’s thesis, highlighting his conclusions regarding the problems related to restricting Covid-19 disinformation and highlighting the advantages and disadvantages found.
