Darbinieka nosūtīšanas tiesiskie aspekti
Abstract
Bakalaura darba tēma ir “Darbinieka nosūtīšanas tiesiskie aspekti”. Bakalaura darba mērķis ir izpētīt darbinieku nosūtīšanas tiesiskos aspektus, kas saistīti ar darba devēja pienākumiem, to regulējumu normatīvajos aktos un kārtību, kādā tiek veikta darbinieka nosūtīšana, tajā skaitā, par darbinieka nosūtīšanas nodokļu tiesiskajiem aspektiem. Darba uzdevums ir noskaidrot darbinieku nosūtīšanas iespējamās (ja tādas ir) problēma un to aspektus, ja darbinieks tiek nosūtīts, analizēt jaunāko tiesu praksi par nodokļu aspektiem un secināt tiesību normu problēmas. Darba struktūru veido anotācijas latviešu un angļu valodā, ievaddaļa, 3 nodaļas ar apakšnodaļām, kopsavilkums un izmantotās literatūras saraksts. Darba nodaļās tiek apskatīts darbinieka nosūtīšanas tiesiskais pamats, vispārējais normatīvais regulējums, kā arī tiesu prakse. Kopējais darba apjoms ir 43 lapas. The title for following thesis is a follows – “Posting of an employee legal aspects“. The purpose of the thesis is to study the legal aspects of posting employees, which are related to the employer's obligations, its regulation in regulatory enactments and the procedure for posting an employee, including the legal aspects of posting taxes. The paper also reviews and analyses common practices in Latvian law to investigate the disputes and current situation in legal affairs regarding posting of workers. The purpose of the thesis is to research legal regulations for staff redundancy due to the reduction of numbers of employees at the company, analyse latest legal practices and gather the issues that are being encountered in judicial development of the law. The content of the thesis consists of annotation in two languages – Latvian and English, introduction, 3 sections with subsections, conclusion, and list of used literature. The main sections include an analysis of the legal requirements of a posting an employee, the legal regulations of it, as well as main conclusions of the courts. The paper is 43 pages long.
