Adopcijas uz ārvalstīm tiesiskā regulējuma ietekme uz bērnu adopciju Latvijā

Abstract

Kopš 2018.gada Latvijā ir veiktas būtiskas izmaiņas normatīvajos aktos, ierobežojot bērnu adopciju uz ārvalstīm, kas veiktas ar mērķi veicināt nacionālā līmeņa adopciju un samazināt ārpusģimenes aprūpē esošo bērnu izbraukšu uz ārvalstīm. Vienlaikus valsts līmenī nav veikti pietiekami pasākumi, lai nodrošinātu bērnu nonākšanu ģimenē. Turklāt līdz šim nav veiktas darbības, lai izvērtētu “adopcijas noslēpuma” atbilstību bērna tiesībām zināt savu izcelšanos, kā arī šī tiesiskā regulējuma ietekmi uz adoptētāju izvēli adoptēt bērnus. Bakalaura darbā ir apskatīts adopcijas jēdziens, tā process un tiesiskās sekas, tostarp raksturota esošā situācija Latvijā adopcijas jomā, analizēta ārvalsts adopcijas tiesiskā regulējuma atbilstība bērna interesēm, vērtēta adopcijas noslēpuma esības ietekme uz adoptētāju izvēli adoptēt bērnu, kā arī sniegti iespējamie priekšlikumi adopcijas tiesiskā regulējuma pilnveidei, lai sekmētu tā atbilstību bērna labākajām interesēm.

Since 2018, significant changes have been made to the regulatory enactments in Latvia, restricting the adoption of children to foreign states, which have been performed with a view to promoting national adoption and reducing the departure of children in extra-family care to foreign countries. At the same time, insufficient measures have been taken at national level to ensure that children are entering the family. In addition, no action has been taken so far to assess the compliance of the “adoption secret” with the right of the child to know their origins, as well as the impact of this legal framework on the choice of adopters to adopt children. The Bachelor's work looks at the concept of adoption, its process and legal consequences, including a description of the existing situation in Latvia in the field of adoption, an analysis of the conformity of the legal framework for foreign adoption with the interests of the child, an assessment of the impact of the existence of an adoption secret on the choice of adopters to adopt a child, as well as possible proposals to improve the adoption legal framework in order to promote its relevance to the child. for the best interests of the child.
