Nodarbinātības tiesiskie aspekti pašvaldībā - iespējamās problēmas un risinājumi

Abstract

Maģistra darba “Nodarbinātības tiesiskie aspekti pašvaldībā – problēmas un iespējamie risinājumi” mērķis ir salīdzināt un analizēt darba tiesisko attiecību jautājumus pašvaldībā kontekstā ar valsts civildienesta attiecībām valsts pārvaldes iestādēs, lai konstatētu, vai ir lietderīgi pašvaldībās noteiktos amatos ieviest un piemērot valsts civildienesta tiesisko attiecību modeli pašvaldības iestādes – centrālās administrācijas darbiniekiem un pārvaldes vadītājiem, ja atbildības līmenis, kā arī veicamais darba saturs, salīdzinot ar valsts pārvaldes iestādēs nodarbināto amatiem, ir līdzīgs, proti, pašvaldībā nodarbinātie tāpat kā valsts civildienesta ierēdņi veido nozares politiku vai attīstības stratēģiju amata kompetences ietvaros, var koordinēt nozares darbību, sadalīt vai kontrolēt finanšu resursus, sagatavot vai izdot administratīvos aktus, sagatavot vai pieņemt citus ar indivīda tiesībām saistītus lēmumus, kā to nosaka Valsts civildienesta likums. Darba ietvaros ir analizēts un salīdzināts tiesisko attiecību modeļu kopīgais un atšķirīgais valsts pārvaldē un pašvaldībā kā vienotā sistēmā, lai konstatētu un izprastu, ka valsts pārvalde ir viens darba devējs kā valsts pārvaldes iestādēs, tā pašvaldībās nodarbinātajiem. Autore ir izvirzījusi priekšlikumu likumdevējam izskatīt iespēju veikt likuma “Par pašvaldībām” un Valsts civildienesta likuma grozījumus, lai noteiktu pašvaldības centrālās administrācijas nodarbināto iekļaušanu valsts civildienestā. The aim of this master's thesis "Legal Aspects of Employment in Local Government - Problems and Possible Solutions" is to compare and analyze employment issues in local government in the context of civil service relations in central government institutions to determine the feasibility of implementation of the civil service legal model in local government in relation to employees of the central administration and heads of administration, given the similar level of responsibility, as well as the content of work to be performed in comparison with the positions of public administration employees, ie local government employees, as well as civil servants shape sectoral policies or development strategies within their scope of responsibilty, co-ordinate the activities of the sector, allocate or control financial resources, prepare or issue administrative acts, prepare or adopt other decisions related to the rights of an individual, as specified by the State Civil Service Law. Within the scope of the thesis, the common and different aspects of legal models in public administration and local government as a unified system are analyzed and compared in order to determine and understand that public administration is a common employer for both public administration and municipal employees. The author has proposed legislative initiatives to consider the possibility of amending the Law "On Local Governments" and the State Civil Service Law in order to include employees of local government central administrations in the state civil service.
