Kopīpašuma izbeigšana.

Abstract

Maģistra darba mērķis ir tiesību aktu, judikatūras un tiesību doktrīnas analīze un interpretācija to kopsakarībā, kopīpašuma izbeigšanas problemjautājumu apzināšana un to iespējamo risinājumu piedāvāšana. Darba uzdevumi ir izpētīt kopīpašuma izbeigšanas vēsturisko izcelsmi un attīstību, prasības par kopīpašuma izbeigšanas tiesību saturu un ierobežojumus, analizēt Civillikumā noteiktos kopīpašuma dalīšanas veidus, to piemērošanas kritērijus, apzināt tās ārvalstu tiesību normas, kas attiecas uz kopīpašuma izbeigšanu un salīdzināt ar Latvijā pastāvošo tiesisko regulējumu, sniegt no prakses izrietošo problēmjautājumu apskati, piedāvājot šo problēmjautājumu konkrētus risinājumus, kā arī izvērtēt Saeimā iesniegto Civillikumā grozījumu projektu.

The aim of the master's thesis is the analysis and interpretation of legal acts, case law and legal doctrine in their connection, identification of the problems of termination of joint ownership and proposal of possible solutions. Tasks are to study the historical origin and development of joint ownership termination, the content and restrictions of joint ownership termination rights, to analyze the types of joint ownership division listed in the Civil Law, their application criteria, to identify those foreign legal norms related to joint ownership termination and to compare with Latvian legislation, to provide an overview of the problems arising from the practice, offering specific solutions to these problems, as well as to evaluate the draft amendments to the Civil Law submitted to the Saeima.
