Pēdējo gadu laikā neskaitāmu rakstu autori, kā arī starptautisko institūciju pārstāvji arvien biežāk izsakās par akadēmiskās brīvības un augstskolu autonomijas nozīmi tiesību uz augstāko izglītību nodrošināšanā. Neskatoties uz to, nereti iztrūkst padziļinātāks skaidrojums par to, kas tad akadēmiskā brīvība un augstskolu autonomija ir, kāda ir pastāvošā problemātika un kā tā risināma. Maģistra darbā ir sniegts akadēmiskās brīvības un augstskolu autonomijas jēdzienu skaidrojums, izklāstīta to būtība un savstarpējā mijiedarbība, kā arī ieskicēta problemātika attiecībā uz valstu tiesībām ierobežot augstskolu autonomiju. Darba ietvaros autore turklāt ir analizējusi Eiropas Cilvēktiesību tiesas, Eiropas Savienības Tiesas un Satversmes tiesas juridisko praksi akadēmiskās brīvības un augstskolu autonomijas jautājumos, izdarot secinājumus par to līdzšinējo attīstību, aktualizētajiem problēmjautājumiem un pilnveides iespējām. In recent years, authors of countless articles, as well as representatives of international institutions, have increasingly spoken out about the importance of academic freedom and institutional autonomy in ensuring the right to higher education. Nevertheless, there is often a lack of in-depth explanation of what academic freedom and institutional autonomy is, what are the underlying problems and how to tackle them. Master’s thesis provides an explanation of the concepts of academic freedom and institutional autonomy, describing their essence and interaction with one another, as well as outlines the problems regarding the right of the state in restricting institutional autonomy. In addition, the author has analysed the legal practice of the European Court of Human Rights, the Court of Justice of the European Union and the Constitutional Court of the Republic of Latvia on issues of academic freedom and institutional autonomy, drawing conclusions on their current development, issues and possible improvements.
