Bezmantnieku mantas problēmjautājumi teorijā un praksē

Abstract

Mantojuma tiesības regulē mantas pāreju citam tiesību subjektam pēc personas nāves, nododot arī no tās izrietošās saistības. Mantojuma tiesisko attiecību noregulēšana nav vienkārša, jo nereti mantinieku nav un manta kļūst piekritīga valstij. Ievērojot bezmantinieku mantas institūta nozīmi civiltiesiskās apgrozības nodrošināšanā un sarežģīto raksturu, darba mērķis ir veikt tā padziļinātu izpēti un konstatēt ar to saistīto problemātiku gan normatīvajā regulējumā, gan praksē. Darba uzdevumi ir analizēt tiesību aktus, doktrīnu, tiesu praksi un apzināt esošo situāciju praksē. Darba ietvaros tiek piedāvāti grozījumi Civillikuma 416.pantā, 659.pantā, 694.pantā, 697.pantā, Notariāta likuma 306.pantā, Ministru kabineta noteikumu Nr.364 4.punktā, 15.punktā un 120.1.punktā.

Inheritance law regulates the transfer of property to another after the death of a person, as well as the transfer of obligations. It is not easy to regulate legal relations of inheritance, because ofter there are no heirs and the property shall escheat to the State. Given the importance of this institute in providing general circulation and its complex nature, the aim of the work is to do an in-depth study of it and establish the related problems in regulatory framework and in practice. The tasks are to analyze the legislation, doctrine, court practice and to identify the current situation. Within the research amendments are proposed to be made in Article 416, Article 659, Article 694, Article 697 of the Civil Law, in Article 306 of the Notary Law and Articles 4., 15., 120.1. of Cabinet Regulation No.364.
