Maģistra darbā tiek pētīts advokāta konfidencialitātes jēdziens un tā ietekme uz pienākumu ziņot par savu klientu. Mērķis ir izpētīt cik lielā mērā tiek ierobežota advokāta konfidencialitāte un kā tā tiek regulēta Latvijas Republikas un starptautiskajos normatīvajos aktos. Darbā tiks izpētīta radusies kolīzija starp konfidencialitātes principu un pienākumu ziņot, cik lielā mērā tiek ierobežota advokāta konfidencialitāte un vai izņēmumiem no konfidencialitātes principa ir likumīgs mērķis un vai tie ir nepieciešami demokrātiskā sabiedrībā. Ziņošanas pienākums par nelikumīgām darbībām ir viens no veidiem, kas palīdz cīnīties un novērst noziegumu, tomēr, lai arī mērķis šiem pasākumiem ir rūpēties par sabiedrības interesēm un cīnīties ar noziedzību, tā rezultātā tiek būtiski samazināts advokāta profesionālā noslēpuma apjoms. The master thesis studies concept of a lawyer's confidentiality and its impact on the obligation to report to his / her client. The objective of the thesis paper is to study the limits of lawyer’s confidentiality and its regulations in the Republic of Latvia and international regulatory enactments. The paper will examine the conflict between the principle of confidentiality and the obligation to report to what extent the confidentiality of a lawyer is restricted and whether exceptions to the principle of confidentiality have a legitimate aim and are necessary in a democratic society. The obligation to report illegal activities is one way of helping to combat and prevent crime, but although these measures are aimed at safeguarding the public interest and combating crime, they significantly reduce the scope of lawyers' professional secrecy.
