Marakešas līguma par Pasaules tirdzniecības organizācijas izveidošanu IX pantā ietvertā konsensusa principa piemērošanas problemātika Pasaules tirdzniecības organizācijas sistēmā

Abstract

Maģistra darbā ietverta informācija par Marakešas līgumā par Pasaules tirdzniecības organizācijas izveidošanu IX pantā iekļauto konsensusa principu, tā piemērošanas un iedibinātās prakses robežām. Vienlaikus uzmanība pievērsta arī Pasaules tirdzniecības organizācijas Strīdu noregulēšanas institūcijas izveidotajai pieejai, risinot strīdus, kuru pamatā starp pusēm nav izdevies sasniegt konsensusu. Teorētiskajā daļā ietverts izvērsts Pasaules tirdzniecības organizācijas funkciju un darbības apraksts, kā arī tās pilnveidošanās par pamatu ņemot Vispārējās vienošanās par tarifiem un tirdzniecību nosacījumiem. Tāpat teorētiskajā daļā tiek apskatīts lēmumu pieņemšanas process un tajā ietilpstošā konsensusa principa saturs Pasaules tirdzniecības organizācijas sistēmā. Savukārt, maģistra darba praktiskajā daļā apskatītas situācijas, kurās Pasaules tirdzniecības organizācijas dalībvalstis nespēj sasniegt konsensusu, kā tas ietekmē Pasaules tirdzniecības organizācijas funkcionēšanu, kā arī vai dalībvalstis savus iebildumus izvirza godprātīgi. Papildu, maģistra darba praktiskajā daļā arī tiek analizēta konsensusa principa izpratne dažādās citās starptautiskās vai reģionālās organizācijās. Tāpat maģistra darbā tiek aplūkots, vai Pasaules tirdzniecības organizācijas lēmumu pieņemšanā ir iespējams atkāpties no konsensusa sasniegšanas, un izmantot citu balsošanas kārtību. Pēc autores domām, Pasaules tirdzniecības organizācija pastāv konsensusa principa piemērošanas problemātika, liedzot ne tikai funkcionēt noteiktām struktūrām, bet arī pieņemt fundamentāli svarīgus lēmumus Pasaules tirdzniecības organizācijas turpmākajai attīstībai.

The master's thesis includes information on the consensus principle, the limits of its application and established practices contained in Article IX of the Marrakesh Agreement establishing the World Trade Organization. At the same time, attention is paid to the approach established by the Dispute Settlement Body of the World Trade Organization dealing with disputes which have failed to reach a consensus between the parties. The theoretical part contains a detailed description of the functioning of the World Trade Organization and its development based on the conditions of the General Agreement on Tariffs and Trade. Theoretical part also discusses the decision-making process and the content of the consensus principle in the World Trade Organization system. On the other hand, the practical part of the master's thesis includes situations where the World Trade Organization Member States are unable to reach a consensus on how it affects the functioning of the World Trade Organization, as well as whether Member States raise their objections in good faith. In addition, the practical part of master’s thesis also analyses the understanding of the Consensus principle in various other international and/or regional organizations. The Master's thesis also looks at whether it is possible to deviate from reaching a consensus in the decisions of the World Trade Organization and to use a different voting arrangement. According to the author, the World Trade Organization have a problem of applying the Consensus principle, not only preventing certain bodies from functioning but also making fundamentally important decisions for the future development of the World Trade Organization.
