Mantojuma masa ir tiesiski radīta fikcija, kas pastāv no mantojuma atklāšanās brīža kā tiesību un saistību kopums ar mērķi nodrošināt šo tiesību un saistību pastāvēšanas nepārtrauktību. Latvijas tiesību telpā trūkst vienotas izpratnes par šī tiesību institūta būtību, pamatprincipiem un tā tiesību īstenošanas tvērumu, normatīvajā regulējumā ir sastopamas pretrunas, un līdz ar to praksē no šī tiesību institūta izrietošās tiesības tiek piemērotas gan atšķirīgi, gan arī kļūdaini. Maģistra darbā autors vērtē šī tiesību institūta problemātiskos aspektus, akcentē šī tiesību institūta nozīmīgo lomu Latvijas mantojuma tiesību sistēmā, pierāda nepieciešamību veidot vienotu tā izpratni, pierāda nepieciešamību pēc tiesiskā regulējuma pārskatīšanas, kā arī piedāvā konkrētus grozījumus spēkā esošajā mantojuma tiesību regulējumā. Inheritance estate is a legally created fiction that exists as a single entity of rights and obligations from the moment of opening of succession with a purpose of ensuring the continuity of the existence of these rights and obligations. There is a lack of a common understanding of the essence of this judicial instrument, its basic principles and the scope of implementation of its rights in the Latvian legal system, and therefore the rights deriving from this judicial instrument are often applied both differently and falsely. In the master's thesis author examines the problematic aspects of this judicial instrument, emphasizes its importance in the Latvian inheritance law system, demonstrates the need to develop a common understanding of it, establishes the need to review the legal framework, and consequently proposes particular amendments to the existing inheritance law framework.
