Videokonferences izmantošana tiesas procesā

Abstract

Maģistra darbā analizēta videokonferences izmantošanas pieļaujamība, izskatot krimināllietu tiesā, izvērtējot Eiropas Savienības un Latvijas Republikas tiesisko regulējumu videokonferenču izmantošanai procesuālo darbību veikšanai kriminālprocesā, kā arī attālinātas tiesas sēdes nozīmēšanas praktiskie un tehniskie aspekti. Darbā atspoguļota arī attālinātu tiesas sēžu organizēšanas problemātika, kas saistīta ar Kriminālprocesa likuma 140. panta interpretāciju un vispārēju tiesu darba digitalizāciju. Darbā veiktie secinājumi attiecas uz jēdziena videokonference satura noskaidrošanu, videokonferences nodrošinājuma izmantošanu kriminālprocesos, ar un bez pārrobežu elementa, tā ietekmi uz kriminālprocesa pabeigšanu saprātīgā termiņā un līdztiesības principa ievērošanu vispārīgajos un sevišķajos kriminālprocesos.

The masters’ thesis “The use of videoconferencing in judicial proceedings” analyses the admissibility of the use of videoconferencing in criminal proceedings, evaluating the legal framework of the European Union and the Republic of Latvia for the use of videoconferencing for the performance of procedural activities in criminal proceedings, as well as practical and technical aspects of making an appointment of a remote hearing. The work also reflects the issue of organising remote hearings, which is related to the interpretation of Section 140 of the Criminal Procedure Law and the digitalisation of the general judicial system. The conclusions made in the thesis mainly concern the interpretation of the concept of videoconferencing, the use of video-conferencing provision in criminal proceedings with and without a cross-border element, its impact on the completion of criminal proceedings within a reasonable time and compliance with the principle of equality in general and specificē criminal proceedings.
