Kriminālprocesa likuma 140. panta "Procesuālās darbības veikšana, izmantojot tehniskos līdzekļus" piemērošanas iespaids uz procesa dalībnieku tiesībām

Abstract

Ņemot vērā pēdējo gadu laikā pieaugošo aktualitāti izmantot tehniskos līdzekļus, maģistra darbā tiks pētīta šo līdzekļu izmantošana procesuālo darbību veikšanā kriminālprocesā. Darba mērķis ir izpētīt tiesiskos un praktiskos aspektus procesuālo darbību veikšanai, izmantojot tehniskos līdzekļus gan pirmstiesas procesā, gan iztiesāšanā un noskaidrot, kāda ir ietekme uz atsevišķām procesa dalībnieku tiesībām. Lai sasniegtu izvirzīto mērķi darba autore veica Latvijas un ārvalstu normatīvā regulējuma izpēti, juridiskās prakses materiālu analīzi, literatūras analīzi un Rīgas tiesas apgabala prokuratūru prokuroru aptauju. Pētījuma rezultātā darba autore konstatē tehnisko līdzekļu izmantošanas ieguvumus, kā arī apzina problēmjautājumus, sniedzot priekšlikumus situācijas uzlabošanai un grozījumiem normatīvajos aktos.

Considering the growing relevance to use technical means in recent years, the use of these means in performing procedural actions in criminal proceedings will be researched in the master's thesis. The aim of the work is to study the legal and practical aspects of performing procedural actions, using technical means both in the pre-trial process and in court, and to determine what is the impact on the individual rights of the participants in the proceedings. In order to achieve this aim, the author conducted a study of Latvian and foreign regulatory framework, an analysis of legal practice materials, an analysis of theoretical materials and a survey of prosecutors of the Riga Judicial Region Prosecution Office. As a result of the research the author of the work identifies the benefits of using technical means, as well as identifies problem issues, providing proposals for improving the situation and amendments to regulatory enactments.
