Ar Administratīvā procesa likuma spēkā stāšanos Latvijas administratīvais process piedzīvoja ļoti būtiskas izmaiņas, un tas bija būtisks pagrieziens moderna administratīvā procesa ieviešanā. Administratīvais process ir svarīga sastāvdaļa tiesiskā valstī, jo ar administratīvā procesa palīdzību, persona var aizstāvēt savas tiesības attiecībās ar valsti un justies pasargāta no iespējamas valsts patvaļas. Ievērojot to, ka administratīvajā procesā pastāv pušu nevienlīdzība, tā ar 2001.gadā pieņemto Administratīvā procesa likumu tika labota, ieviešot administratīvajā procesā objektīvās izmeklēšanas principu. Objektīvās izmeklēšanas princips, pretēji sacīkstes principam, paredz tiesām pienākumu aktīvi iesaistīties tiesvedības procesā, lai noskaidrotu objektīvo patiesību, kas var izpausties kā norādījumu un ieteikumu došana lietas dalībniekiem vai pierādījumu vākšana pēc tiesas iniciatīvas. Tieši objektīvās izmeklēšanas principa ieviešana administratīvajā procesā, ņemot vērā pušu faktisko nevienlīdzību, spēj nodrošināt pieteicēja tiesības uz taisnīgu tiesu, jo ar objektīvās izmeklēšanas principu tiek nodrošināta pušu līdztiesība, kuru ar sacīkstes principu administratīvajā procesā nav iespējams nodrošināt. Ņemot vērā to, ka mūsdienu administratīvais process ir veidots tā, lai tas pēc iespējas spētu nodrošināt cilvēka tiesību ievērošanu, pēc 20 gadiem, kopš ticis pieņemts Administratīvā procesa likums, ir ļoti būtiski aplūkot objektīvās izmeklēšanas principa, kā administratīvā procesa pamatprincipa, piemērošanu, proti, vai šāds regulējums spēj pilnvērtīgi nodrošināt cilvēka pamattiesību ievērošanu, vai tomēr pastāv kādas problēmas, un ir nepieciešams meklēt tām risinājumu. Maģistra darba mērķis ir izpētīt objektīvās izmeklēšanas principa piemērošanu administratīvajā procesā un ar tā piemērošanu saistītos problēmjautājumus, cita starpā raugoties uz Latvijas administratīvo procesu arī no Eiropas Cilvēktiesību tiesas perspektīvas. With the Administrative Procedure Law coming into force, the administrative process of Latvia underwent very significant changes, furthermore this was a significant turnaround in the implementation of modern administrative proceedings. Administrative proceedings are an important part of a state governed by the rule of law, because through administrative proceedings a person can defend his or her rights in relations with the state and feel protected from possible arbitrariness of the state. Considering that there is inequality between the parties in the administrative procedure, it was corrected by the Administrative Procedure Law adopted in 2001, introducing the principle of objective investigation in the administrative procedure. The principle of objective investigation, contrary to the adversarial principle, requires courts to be actively involved in the proceedings to establish the objective truth, which may take the form of giving instructions and recommendations to the parties or gathering evidence on the court's initiative. It is precisely the introduction of the principle of objective investigation in the administrative procedure, considering the actual inequality of the parties, that can ensure the applicant's right to a fair trial because the principle of objective investigation ensures equality between the parties, which cannot be ensured by the adversarial principle in administrative proceedings. Taking into account that the modern administrative process is designed to ensure compliance with human rights as much as possible, after 20 years since the adoption of the Administrative Procedure Law, it is very important to look at the application of the principle of objective investigation, as a basic principle of administrative procedure, namely, whether such regulation is able to fully ensure respect for fundamental human rights, or whether there are any problems, and it is necessary to seek a solution to them. The aim of the master's thesis is to study the application of the principle of objective investigation in the administrative procedure and issues related to its application, as well as to examine the administrative procedure of Latvia from the perspective of the of the European Court of Human Rights.
