Cietsirdība un vardarbība pret nepilngadīgo

Abstract

Maģistra darba ietvaros tiks aplūkoti Krimināllikuma 174.panta teorētiskie aspekti, kā arī cietsirdības un vardarbības pret nepilngadīgām personām izpausmes, kas konstatētas tiesu praksē. Cietsirdība un vardarbība pret nepilngadīgajiem ir aktuāla problēma Latvijā un pasaulē, kuru rezultātā nepilngadīgajiem var tikt nodarītas nelabvēlīgas sekas veselībai. Tiesu nolēmumos salīdzinoši bieži saskatāmas kļūdas attiecībā uz Krimināllikuma 174.pantā paredzēto seku “fizikas vai psihiskas ciešanas” konstatēšanu. Pētījuma mērķis ir veicināt efektīvu nepilngadīgo tiesisko aizsardzību pret vardarbību un cietsirdību. Darba uzdevumus ir aplūkot un analizēt konkrētā noziedzīgā nodarījuma sastāva pazīmes, ar tām saistīto tiesu praksi, fizisku un psihisku ciešanu izpratni, un kādu iespaidu tās atstāj uz nepilngadīgā nākotni.

In this Master’s thesis, the theoretical aspects of Article 174 of the Criminal Law, as well as the manifestations of cruelty and violence against minors, established in the case law, will be examined. Cruelty and violence against minors is a relevant problem in Latvia and worldwide, which can result in adverse health consequences for minors. The court findings are relatively often incorrect as regards the determination of the consequences of “physical or mental suffering” as provided for in Article 174 of the Criminal Law. The aim of the research is to promote effective legal protection of minors against violence and cruelty. The objectives of the research are to examine and analyse the elements of the specific offence, the related case law, the understanding of physical and mental suffering, and the impact it has on the future of the minor.
