Ar 2009. gada 1. jūlija Kriminālprocesa likuma grozījumiem aizskartās mantas īpašnieka statuss tika iekļauts Kriminālprocesa likumā. Aizskartās mantas īpašnieks ir persona, kurai tiesības rīkoties ar mantu procesa gaitā ir ierobežotas. Salīdzinājumā ar apsūdzēto pret aizskartās mantas īpašnieku netiek izvirzīta apsūdzība, bet tiek izteikts pieņēmums, ka personas manta ir iegūta noziedzīgā nodarījuma rezultātā vai tai ir saistība ar noziedzīgo nodarījumu. Šāds procesuālais statuss paredzēja trešās personas iesaisti Kriminālprocesā, salīdzinājumā ar Civilprocesu vai Administratīvo procesu. Personai tika nodrošināta iespēja sniegt paskaidrojumus attiecībā uz mantu, kā arī īstenot savas tiesības tiesas procesā, pirms lietā tiek pieņemts galīgais nolēmums. Bakalaura darba mērķis ir saprast, kurā brīdī un kura persona iegūst aizskartās mantas īpašnieka statusu kriminālprocesā, kāds tiesību aizskārums pret personu tiek veikts un kādas ir mantas īpašnieka tiesības uz likumisko interešu aizsardzību. Darba izstrādes gaitā tika pētīts un analizēts normatīvais regulējums, tiesu prakse un juridiskā literatūra. Bakalaura darba ietvaros autors piedāvā pilnveidot un uzlabot spēkā esošo normatīvo regulējumu, tādejādi norādot uz nepilnībām, kas novērojamas praksē. By amendments to the Criminal Procedure Law of 1 July 2009, the rights and duties of the Owner of Property Infringed during Criminal Proceedings was included in the Criminal Procedure Law. Owner of Property Infringed during Criminal Proceedings is a person who has limited rights to dispose the property during the course of the proceedings. In comparison to the accused, the owner of the infringed property is not charged, but a presumption is made that the person's property was acquired as a result of a criminal offence or has a connection to the criminal offence. Such procedural status requires the involvement of a third party in criminal proceedings compared to civil or administrative proceedings. The person was given the opportunity to provide explanations regarding the property as well as to exercise his or her rights in court proceedings before a final ruling is given in the case. The purpose of the Bachelor's theses is to understand at what point and which person acquires the status of owner of the infringed property in criminal proceedings, what impairment of rights against the person is performed and what is the right of the owner of the property to the protection of lawful interests. Legislation, case law and legal literature were examined and analysed in the course of drafting the work. Within the framework of the Bachelor's theses, the author proposes to improve the current regulatory framework, thus pointing to the shortcomings observed in practice.
