Sprudzāne A. (2022) Kredītkaršu un debetkaršu apkalpojošo līgumu juridiskā daba. Maģistra darba. Vadītājs lektors Pauls Zeņķis. LU JF, maģistra akadēmisko studiju programma “Tiesības un organizāciju pārvaldība”. Maģistra darba rakstīts latviešu valodā, to veido ievads, četras daļas, secinājumi un priekšlikumi. Maģistra darba mērķis ir izprast debetkaršu un kredītkaršu apkalpojošo līgumu juridisko dabu, izpētīt tiesu praksi, kas saistīta ar karšu lietošanu, un izanalizēt fizisku personu izpratni par abiem karšu veidiem. Nozīmīgākie secinājumi un priekšlikumi: autores veiktajā aptaujā, kurā piedalījās 110 respondenti, tika noskaidrots, ka 60% aptaujāto ikdienā lieto tikai debetkarti, tāpar 59% izvēlēto norēķinu kartes veidu lieto vairāk nekā 10 gadus. 26% aptaujāto norādījuši, ka neizprot starpību starp debetkartēm un kredītkakrtēm. No tiem, kas starpību starp abiem karšu veidiem izprot, lielākā daļa sniedza precīzas atbildes par saistībām, kas rodas kredītkaršu līgumu rezultātā, un daļējas atbildes par saistībām, parakstot debetkartes līgumu. Galvenie priekšlikumi - autore uzskata, ka to iestāžu, kas saviem klientiem piedāvā norēķinu kartes, mājas lapās ir nepieciešams norādīt paziņojumu par karšu būtību, tāpat nepieciešams norādīt paziņojumu, kuru norāda pie cita veica (īpaši īstermiņa) kredītiem “Kredītkarte ir kredīta veids, aicinām aizņemties atbildīgi, izvērtējot iespējas parādu atmaksāt”. Šādas prasības nepieciešams norādīt Maksājumu pakalpojumu un elektroniskās naudas likuma 10. nodaļā, pievienojot papildus pantu un MK Noteikumos par patērētāja kreditēšanu 14. punktā, pievienojot 14.8. punktu. The master's thesis is written in Latvian, it consists of an introduction, four parts, conclusions and proposals. The volume of the work is 65 pages, it includes 11 pictures, 1 table. The bibliographic list includes sources in Latvian and English. 4 appendices are attached to the work. The aim of the master's thesis is to understand the legal nature of debit card and credit card service contracts, to study court practice related to the use of cards, and to analyze the understanding of natural persons about both types of cards. The most important conclusions and proposals: in the survey conducted by the author, in which 110 respondents took part, it was found that 60% of the respondents use only debit cards on a daily basis, therefore 59% have been using the chosen type of payment card for more than 10 years. 26% of respondents stated that they do not understand the difference between debit cards and credit cards. Of those who understand the difference between the two types of cards, most gave accurate answers about the obligations that arise from credit card agreements and partial answers about the obligations when signing a debit card agreement. The main proposals - the author believes that on the websites of institutions that offer payment cards to their customers, it is necessary to indicate a statement about the nature of the cards, and it is also necessary to indicate a statement that is indicated on other (especially short-term) loans "Credit card is a form of credit, we invite you to borrow responsibly, evaluating the possibilities to repay the debt". Such requirements need to be specified in Chapter 10 of the Law on Payment Services and Electronic Money, adding an additional article, and in Clause 14 of the Regulations on Consumer Lending, adding 14.8. point.
